Authorization
On May 28, 1996 United Air Lines, Inc. ("United") and Thai Airways International Public Company Limited ("THAI") requested the necessary Department of Transportation ("DOT") authorizations to offer code-share services on certain of each other's flights between the U.S. and Thailand, services that were described in an agreement entered into by United and THAI on May 1994. That agreement was filed with the DOT's Licensing Division at the time of application.

In an extraordinary display of hypocrisy,United is continuing to urge that the proposed American/British Airways alliance is too big to be approved. United has repeatedly sought to delay approval of the AA/BA alliance, as well as codesharing arrangements between American and other airlines, by demanding oral evidentiary hearings, and by seeking to require the parties to file unprecedented volumes of documents.

In Order 97-5-22, the Department gave its final approval to the code-share arrangement between United and Thai Airways International, pal ("THAI"). In granting that approval over the objections of American, the Department made the following observations: We find that approval of the proposed operations is consistent with the public interest. The aviation agreement and Memorandum Of Understanding between the United States and Thailand specifically provide for the proposed code-sharing operations, and the proposed United/Thai Airways services here will make use of those valuable opportunities.

There is no principled basis for permitting the alliance between United and Thai Airways to continue (or to be expanded) without requiring that United and its partners produce information and documents of the kind and quantity that American has been compelled to produce in its dockets. The Department should not approve or renew any of United's services that entail cooperative with Star Alliance partners or potential partners (including Thai Airways, Air New Zealand, Cathay Pacific, and Singapore Airlines), until the Department has had the opportunity to review fully the competitive effects of the Star Alliance, with comments from interested parties based on documents and other evidence that United should be ordered to produce.

On August 15, 1997, Thai and United jointly applied for renewal of (1) Thai's exemption to engage in scheduled foreign air transportation of persons, property and mail (a) between Thailand and the coterminal points Chicago, Denver, Las Vegas, New York/Newark, San Francisco and Washington, D.C., and to serve Seattle as a coterminal point with Los Angeles; (b) to serve the Thailand-San Francisco market via Taipei, without local traffic rights between Taipei and San Francisco; and (c) to serve the Thailand-Washington, D.C. market via Paris, without local traffic rights between Washington, D.C. and Paris, under a code-share arrangement with United; (2) Thai's statement of authorization to place United's designator code on Thai's Hong Kong-Bangkok, Taipei-Bangkok and Tokyo-Phuket flights; and (3) United's statement of authorization to put Thai's designator code on United's flights between Los Angeles and Chicago, Denver, Las Vegas, New York/Newark, San Francisco and Seattle; and between Taipei and San Francisco and Paris and Washington. The Department originally granted these authorities based on a finding that they were consistent with the public interest and the Air Transport Agreement and the Memorandum of Understanding ("MOU") between the Kingdom of Thailand and the United States, signed May 8, 1996. The Department has yet to act on the renewal application, but the authorities remain in effect under the Administrative Procedure Act provisions implemented by 14 C.F.R. Part 377.
