Application for Renewal of Exemptions
In OST-96-1353, most recently renewed by Order 96-7-43, July 30, 1996, American holds authority to serve from a point or points in the United States, via intermediate points, to Manaus, Brasilia, Rio de Janeiro, Sao Paulo, Recife, Porto Alegre, Belem, Belo Horizonte, and Salvador, Brazil, and beyond Brazil to Argentina, Uruguay, Paraguay, and Chile.
In OST-97-2419, initially granted by Order 97-9-29, September 24, 1997, American holds authority to serve from the United States to Cuiaba, Curitiba, Florianapolis, Fortaleza, Foz do Iguacu, Goiania, Joinville, Natal, Ribeirao Preto, and Vitoria, Brazil, and the right to integrate such authority with its U.S.-South America (Route 389) and other U.S.-Brazil exemption authority, for purposes of a codesharing arrangement between American and TAM-Transportes Aereos Meridionais, S.A.
American also notes that it has two pending certificate applications for broad U.S.-Brazil authority, one in Docket 48301, filed on August 18, 1992, and the other in Docket 48343 (renewal and realignment of Route 398), filed on September 10, 1992. There were no answers in opposition to either of those applications with respect to Brazil, and each remains pending. American urges the Department to act expeditiously on these longstanding applications.

In OST-1996-1353, most recently renewed by Notice of Action Taken on January 20, 2004, American holds authority to serve from a point or points in the United States, via intermidate points, to Belem, Belo Horizonte, Brasilia, Manaus, Porto Alegre, Recife, Rio de Janeiro, Salvador and Sao Paulo, Brazil, and beyond Brazil to Argentina, Chile, Paraguay, and Uruguay. Absent this renewal application, such authority would expire on January 20, 2006.
In OST-1997-2419, most recently renewed by Notice of Action Taken, January 20, 2004, and amended on July 13, 2004, American holds authority to serve from the United States to Campo Grande, Cuiaba, Curitiba, Florianopolis, Fortaleza, Foz do Iguacu, Goiania, Joinville, Londrina, Maceio, Natal, Navagantes, Parana, Porto Velho, Ribeirao Preto, Sao Luis, Teresina, Vilhena, and Vitoria, Brazil, and the right to integrate such authority with existing certificates and exemptions, for purposes of a codesharing arrangement between American and TAM - Linhas Aereas, S.A. Absent this renewal application, such authority would expire on January 20, 2006 or (with respect to Campo Grane, Londrina, and Maceio) July 13, 2006.
American also requests amendment of its exemption in OST-1997-2419 to grant codeshare authority coextensive with the US-Brazil Air Transport Agreement, as amended, which permits codeshare service between the US and up to 30 points in Brazil name by the US. Such broad authority was requested by United Air Lines, Inc. on November 4, 2005 in OST-1996-2358. The Department should treat American and United equally with respect to the grant of US-Brazil codeshare rights.

Answer of United Air Lines to Application of American for Renewal and Amendment Exemptions
United Air Lines, Inc. submits the following answer to the above captioned application of American Airlines, Inc.:
1. By its application, American seeks renewal and amendment of its exemptions to serve Brazil directly and pursuant to its code-share with TAM. United filed an application for renewal and amendment of its similar exemptions to serve Brazil in Dockets OST-1996-1346 and 1997-2358 on November 4, 2005.
2. In both eases, the carriers seek an amendment to include code-share authority to serve points in Brazil that is coextensive with that available under the U.S.-Brazil bilateral air services agreement.
3. United has no objection to the approval of American's application so long as United's own pending application for similar authority, including its request for amendment, is granted no later than American's application.

American's exemption, most recently renewed by Notice of Action Taken on March 15, 2006, authorizes service between points in the United States, via intermediate points, and Belem, Belo Horizonte, Brasilia, Manaus, Porto Alegre, Recife, Rio de Janeiro, Salvador, and Sao Paulo, Brazil, and beyond Brazil to Argentina, Chile, Paraguay, and Uruguay. Absent this renewal application, such authority would expire on March 15, 2008.
In response to the Department's notice of August 23, 2005 on streamlining regulatory procedures (OST-2005-22228) American has requested corresponding certificate authority for the above-referenced U.5.-Brazil routes. See Supplement to Application for Renewal of Route 602, August 26, 2005 (OST-2000-8516) . We urge expedited approval of that application to avoid the need for successive renewals in exemption dockets.
American's exemption in OST-1997-2419 authorizing service, on a codeshare basis only, between points in the United States and points in Brazil, limited to the 30 points named under the U.S.-Brazil Air Transport Agreement. American is not seeking renewal of its codeshare-only exemption.
