Federal Express is withdrawing its Complaint based on the conclusion of a subsequent agreement between the United States and Japan which confirmed the right of Federal Express to operate unrestricted beyond-Japan all-cargo air services with 5th freedom traffic rights, as provided for under the 1952 U.S.-Japan Civil Air Transport Agreement, as amended.
