Withdrawal of Complaint of Federal Express

International Air Transportation Fair Competitive Practices Act

Federal Express is withdrawing its Complaint based on the conclusion of a subsequent agreement between the United States and Japan which confirmed the right of Federal Express to operate unrestricted beyond-Japan all-cargo air services with 5th freedom traffic rights, as provided for under the 1952 U.S.-Japan Civil Air Transport Agreement, as amended.

1. We dismiss, without prejudice, the complaint of Federal Express Corporation against the Government of Japan, in Docket OST-96- l 129;
2. We dismiss, without prejudice, the complaint of Northwest Airlines, Inc., against the Government of Japan, in Docket OST-96-1500;
3. We terminate the proceedings in Dockets OST-96-1129 and OST-96-1500; and
4. We serve this order on all parties listed in the captioned Dockets in this matter.
