Application for Renewal of Exemption, Route Integration
Authority and Allocation of Frequencies
Renewal, for a period of two years, of (i) its exemption from the requirements of 49 U.S.C. 41101, permitting it to engage in scheduled all-cargo service between Miami, Florida and the co-terminal points Quito and Guayaquil, Ecuador, (ii) its authority to integrate this service with its existing Caribbean and Central/South American authority; and (iii) its allocation of two weekly frequencies to conduct these services. Fine Air invokes the automatic extension provisions of the Administrative Procedure Act, 5 U.S.C. § 558(c), as implemented by Part: 377 of the Department's Regulations, to enable it to continue its operations to Ecuador pending final determination of its renewal application. Fine Air commenced scheduled service to Ecuador in October 1995. It has since been conducting scheduled operations twice a week over a Miami-Guayaquil-Quito-Miami routing. Fine Air Utilizes DC-8 aircraft to conduct these flights.

The service list originally attached to that pleading inadvertently omitted counsel for Southern Air Transport. A copy of the pleading was, nonetheless, mailed yesterday to counsel for Southern Air, as it was to all other carrier representatives on the revised service list.

Fine Air commenced scheduled service to Ecuador in October 1995. It has since been conducting scheduled operations twice a week over a Miaml-Guayaquil-Quito-Miami routing. Fine Air utilizes DC-8 aircraft to conduct these flights. Fine Air does not anticipate any change in these operations.

By Order 95-2-19 issued herein, the Department awarded the former certificated air carrier Fine Air Services, Inc. ("Old Fine Air") an exemption to provide scheduled all-cargo service between Miami, Florida and the co-terminal points Quito, Ecuador and Quyaquil, Ecuador, together with an allocation of two (2) weekly U.S.-Ecuador frequencies with which to perform this service. See: Order 95-2-19 issued herein. By Order 2000-8-5, the Department then approved the transfer of all of the certificate, exemption and other authorities held by the Old Fine Air to Arrow Air, Inc., including all frequency allocations previously awarded to the Old Fine Air. However, since the Old Fine Air's underlying exemption authority to serve Ecuador was duplicative of the exemption authority to serve Ecuador already held by Arrow Air, Old Fine Air's Ecuador exemption authority was not transferred and was canceled. See: Order 2000-8-5, 11 and n. 16. However, the two (2) Ecuador frequency allocations held by the Old Fine Air were specifically transferred to Arrow Air to be added to the three (3) weekly frequencies already held by it.
In addition to the three (3) weekly frequencies awarded to it, Arrow Air continues to fully use the allocation of two (2) weekly U.S.-Ecuador frequencies transferred to it by Order 2000-8-5. Arrow Air hereby requests that this frequency allocation be renewed for a further period beyond March 24, 2002, to be used in conjunction with the allocation of three (3) weekly frequencies allocated.
