Application for Amendment and Extension of an Exemption
DHL Aero Expreso will continue operating a B-727-200 freighter aircraft between Panama and Miami, carrying both cargoes tendered to the IDOL Worldwide Express. service network and cargoes tendered by independent forwarders. With the broader exemption, it plans to provide additional all-cargo services, at least initially, between Panama and Miami via Costa Rica as an intermediate or beyond point, as permitted in the Open Skies Agreement.

DHL Aero Expreso, S.A. hereby applies for renewal of its exemption from the requirements of 49 U.S.C. § 41301, authorizing Aero Expreso to provide (1) scheduled foreign air transportation of property and mail from points behind Panama via Panama and intermediate points to a point or points in the United States and beyond; and scheduled, all-cargo services between the United States and any point or points; and (2) all-cargo charter operations to the from the United States. Aero Expreso further requests renewal of its waiver from the requirement of 14 C.F.R. § 212.9(b)(1) that fifth-freedom charter flights conducted under this exemption authority obtain prior Departmental approval. To enable Aero Expreso to continue exercising these exemption authorities pending Departmental action on the instant application, Aero Expreso hereby invokes the automatic extension provisions of the Administrative Procedure Act as implemented by Part 377 of the Department's regulations.
Pursuant to the above described authority, during the past two years, Aero Expreso has operated scheduled and charter all-cargo services to the United States. Aero Expreso wishes to continue offering such services.
