Respectfully requests that the exemption authorizing KAL to engage in scheduled foreign air transportation of person, property and mail between the Republic of Korea and Saipan. and integrating KAL's Saipan authority with its currently effectively permit and exemption authorities. be renewed for a period of one year. KAL further requests such different and additional relief as the Department may deem appropriate.

As the Department well knows, the Government of Korea is not and, for almost two years, has not been in compliance with its procedural and substantive obligations under the U.S.-Korea Air Transport Agreement. For that extended period, the Government of Korea has barred World from exercising its indisputable right to provide service in the Korean markets it is designated and licensed to serve. Despite the efforts of the U.S. Government and World, the Government of Korea continues to ignore its bilateral obligations to the U.S. Government and World and, to World's knowledge, has even refused to engage in any discussions which could help resolve this controversy in a fair and equitable manner. In these circumstances, KAL cannot hope to satisfy the relevant "public interest" statutory standard. Accordingly, there can be no basis for continuing approval of KAL's operations in this important and valuable U.S. market.

When stripped of its rhetoric, World's answer does not raise any issues that have not already been addressed by the Department in dealing with several applications submitted by KAL in the last twelve months or so. The fundamental thrust of World's objection is its claim that the Government of the Republic of Korea has not allowed World to institute new scheduled all-cargo service in the U.S.-Korea market with beyond service from Korea to Malaysia. While KAL does not have firsthand knowledge of the discussions between World and the Korean civil aviation authorities regarding this matter, KAL understands that the service proposed by World would have replaced a service that was previously operated by a non-U.S. carrier pursuant to a wet lease agreement with World. KAL also understands that the Korean Government raised what appear to have been legitimate questions regarding such an operation and -- more than a year ago -- requested additional information from World regarding the proposed new service. KAL further understands that World has yet to respond fully to the Korean Government's request.

KAL's suggestion that the Department should continue to defer asserting an effective response to the Government of Korea's recalcitrance by pursuing World's controversy with the Government of Korea "through other means" borders on silliness. For almost two years, the Department has effectively stayed its hand, limited its response, and refused to take decisive action against renewal applications filed by Korean carriers. The Department's patience has not been rewarded, and there is no reason to believe that further forbearance will be productive inany way.
