Application for Renewal of an Exemption

Federal Express is continuing to utilize its inter-regional operating flexibility exemption authority to permit the operation of a variety of inter-regional and intra-regional cargo flights throughout the world. For example, Federal Express now operates a daily round-the-world DC-10-30 freighter flight over a routing originating at Indianapolis or Newark (on different days), and proceeding eastbound to Federal Express' hubs in Europe (Paris), the Middle East (Dubai), Mumbai, India, Bangkok, Thailand, and onward to Federal Express' intra-Asia hub at Subic Bay in the Philippines, with the final leg terminating at Chicago. In addition to that around-the-world operation, Federal Express continues to operate other inter-regional flights on a regular basis.

The exemption authority at issue grants Federal Express operating flexibility to provide round-the-world scheduled all-cargo air transportation via various points named in its certificates and exemption authority, and other inter-regional and intra-­regional cargo services, subject to applicable bilateral and certificate restrictions.

Federal Express is continuing to utilize its inter-regional operating flexibility exemption authority to permit the operation of a variety of inter-regional and intra-regional all-cargo flights throughout the world. For example, Federal Express now operates two daily round-the-world MD-11 freighter flights over routings originating at Indianapolis and Memphis, and proceeding eastbound to Federal Express' European hub at Paris, France, and Federal Express' intra-Asia hub at Subic Bay in the Philippines, via intermediate stops in Frankfurt, the Middle East (Dubai), Mumbai, India, and/or Bangkok, Thailand, with the final leg beyond Subic Bay terminating at Indianapolis or Chicago. In addition to those eastbound around-the-world operations, Federal Express now also operates a daily westbound inter-regional flight with MD-11 and A-310 freighter aircraft operating from Memphis to Subic Bay via intermediate stops at Anchorage and at points in the Asia/Pacific region and onward (via a change of gauge at Subic Bay) to points in India, the Middle East, Europe, and back to Memphis.

Application for Renewal of Exemption

Hereby applies, pursuant to 49 U.S.C. § 41109 and Subpart C of the Procedural Regulations of the Department of Transportation (14 C.F.R, Part 302.301, et seq.) for renewal of certain temporary exemption authority. This authority allows FedEx Express to integrate its existing authority contained in its certificates of public convenience and necessity for Routes 119, 205-F, 451, 472, 473, 553, 568, 638, 748, 787, and 793, and all other international route authority granted to FedEx Express by exemption. The exemption authority at issue grants FedEx Express operating flexibility to provide around-the-world scheduled allcargo air transportation via various points named in its certificates and exemption authority, and other inter-regional and intra-regional cargo services, subject to applicable bilateral and certificate restrictions.

Current Worldwide Service FedEx Express is continuing to use its operating flexibility exemption authority to permit the operation of an integrated system of all-cargo flights throughout the world. For example, FedEx Express currently operates daily westbound MD-1 i freighter flights over routings originating at either Memphis and Newark, with stops at Anchorage, Seoul, Taipei, and Hong Kong and terminating at either Hong Kong or Subic Bay.' In the eastbound direction, flights operate daily from Hong Kong, Singapore, Taipei, or Penang through FedEx Express facilities in Japan, and Anchorage before terminating in the United States at either New York or Memphis.

Application for Renewal of an Exemption

Federal Express Corporation hereby seeks renewal of its route integration authority. FedEx Express relies on the operating flexibility available under this authority to operate its highly efficient air express/cargo network.

FedEx Express asks that the Department renew this exemption authority on an indefinite basis with no fixed expiration date based on the non-exclusive and noncontroversial nature of the authority at issue. In the alternative, FedEx Express requests that its worldwide operating flexibility exemption authority be renewed for two years.
