America West also requests that, in order to facilitate future processing of renewal applications (in the absence of indefinite authority), and to ease the administrative burden imposed on the Department by multiple renewal applications, Docket OST-1998-3581 be consolidated into Docket OST-1995-736.

On July 23, 2004, America West Airlines, Inc. applied to renew its existing exemption authority from 49 U.S.C. § 41101 to operate scheduled combination service between Las Vegas, Nevada and Mexico City, Mexico, and between Phoenix, Arizona on the one hand and San Jose del Cabo, Mexico; Mazatlan, Mexico; Mexico City, Mexico; Puerto Vallarta, Mexico; Manzanillo, Mexico; Acapulco, Mexico; Cancun, Mexico; and Ixtapa/Zihuatanejo, Mexico on the other hand.

America West hereby amends the Application by withdrawing the request to renew its exemption to operate in the Las Vegas, Nevada- Mexico City, Mexico market. This Amendment will also serve as America West's dormancy notice for the Las Vegas - Mexico City.

Application for Renewal of Exemption Authority

America West applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property and mail between (1) the terminal point Phoenix, Arizona and the terminal point San Jose del Cabo, Mexico, (2) the terminal point Mazatlan, Mexico, (3) the terminal point Mexico City, Mexico, (4) the terminal point Puerto Vallarta, Mexico, (5) the terminal point Manazanillo, Mexico, (6) the terminal point Acapulco, Mexico, (7) the terminal point Cancun Mexico and (8) the terminal point Ixtapa/Zihuatanejo, Mexico.

America West currently provides scheduled air service in the above-listed markets using Airbus A-319/320, Boeing 737 and/or Boeing 757 aircraft. The carrier's service in the PHX-MZT and PHX-MZO markets operates on a seasonal basis, while its service between PHX and SJD, MEX, PVR, ACA, CUN and ZIH is year-round.

America West's current exemption is effective through August 31, 2006.

America West requests a waiver of the requirement that renewal applications be filed within sixty days prior to the expiration of the authority. A waiver of the 60-day requirement for America West would not prejudice any party.

America West states that it serves the Phoenix-Mazatlan and Phoenix-Manzanillo markets on a seasonal basis, and serves all of the other markets on a year-round basis.

The carrier requested a waiver of the Department's 60-day advance filing requirements set forth in 14 C.F.R. 377.10, so that American West could rely upon the automatic extension provisions of 5 U.S.C. Section 558(c), to keep the subject authority in effect beyond the prescribed expiration date of August 31, 2006, pending the Department's action on this renewal application.

Cancellation of Exemption Authority

On September 26, 2007, America West Airlines, Inc. and US Airways, Inc. combined their operations under US Airways' Operating Certificate. As a result of this operational consolidation, domestic and international air service for both companies is now being conducted pursuant to certificate and exemption authority previously granted to US Airways.

Accordingly, America West hereby requests that the Department cancel its Certificate of Public Convenience and Necessity for Interstate Air Transportation, issued on July 8, 1998, by Order 1998-7-6. America West further requests that the Department cancel the certificate and exemption authority for international service held by America West.
