Application for Renewal of an Exemption
Currently operating two nonstop flights per week between Philadelphia and St. Maarten, utilizing Boeing 757 aircraft. In addition, US Airways operates one weekly nonstop flight between Charlotte and St. Maarten, also utilizing Boeing 757 aircraft. Although not presently serving St. Maarten from the Baltimore/Washington gateway, US Airways seeks renewal of its BWI authority in order to retain the flexibility to offer the service again during the exemption period should conditions warrant.

Philadelphia fully supports US Airways' exemption renewal application to operate nonstop scheduled foreign air transportation between, inter aiia, Philadelphia and St. Maarten. Nonstop service from Philadelphia to St. Maarten -- and other Caribbean points -- is important to the Philadelphia region. Currently US Airways is the only carrier offering nonstop service in the Philadelphia-St. Maarten market.

By this application, US Airways seeks to renew this exemption authority for another two-year term. US Airways currently provides two weekly, nonstop roundtrips (Saturday/Sunday) between Philadelphia and St. Maarten and one weekly, nonstop roundtrip on Saturdays between Charlotte and St. Maarten. Although not presently operating nonstop service between Baltimore and St. Maarten, US Airways does provide connecting service between these two points on weekends (Saturday/Sunday). The nonstop services from Philadelphia and Charlotte are operated with 182-seat B-757 aircraft. Although US Airways is not presently serving St. Maarten nonstop from the BWI gateway, US Airways nonetheless seeks renewal of its BWI-SXM authority in order to retain the operational flexibility to offer the service again during the exemption period should market conditions warrant.

US Airways has an existing exemption to conduct scheduled foreign air transportation of persons, property, and mail between Charlotte, NC, Philadelphia, PA, and Baltimore/Washington, on the one hand, and St. Maarten, Netherlands Antilles, on the other. (See Notice of Action Taken in this docket dated June 8, 2001.)
We note that although Daystar Airways Ltd. d/b/a Nevis Express may conduct the requested operations on behalf of US Airways under its worldwide charter authority, it may not serve these points using it own code (i.e. on a scheduled basis) until its pending application in Docket OST-99-5062 for an amendment to its certificate for Route 786 has been approved and an amended certificate of public convenience and necessity has been issued.

Application for Renewal of an Exemption
US Airways operates these nonstop services from its hub networks at Charlotte and Philadelphia, thereby enabling US Airways to offer convenient, on‑line connecting service to St. Maarten and beyond from a large number of communities in the eastern United States.
US Airways operates service between the United States and St. Maarten using Airbus and/or Boeing aircraft. It also offers code-share service operated by a GoCaribbean (Daystar d/b/a Nevis Express) network partner between San Juan and St. Maarten.

Application for Renewal of an Exemption
US Airways applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between a point or points in the United States, on the one hand, and a point or points in St. Maarten, Netherlands Antilles, and points beyond, on the other.
US Airways currently provides daily scheduled air service between the United States and St. Maarten, Netherlands Antilles, using Airbus and/or Boeing aircraft. Renewal of US Airways' exemption will greatly serve the public interest by providing substantial competition to other carriers serving St. Maarten, Netherlands Antilles. US Airways operates these nonstop services from its hubs in Charlotte and Philadelphia, thereby enabling US Airways to offer convenient, on-line connecting service to St. Maarten, Netherlands Antilles from a large number of communities in the United States. US Airways also offers code-share service operated by Caribbean Sun Airlines, Inc., a United States air carrier, between San Juan, Puerto Rico, and St. Maarten, Netherlands Antilles.
