Amendment No. 2 to Application and Motion for Leave to Amend

The authority United is requesting by this amendment will enable it to offer competitive services between the U.S. and those points in South America it is not currently authorized to serve. This would expand its authority to serve Colombia to include all points in that country that may be served consistent with the applicable bilateral agreement. Peru is added to this route to provide additional routing flexibility for services to that country for which United holds authority in its Certificate of Public Convenience and Necessity for Route 703. Finally, United requests the addition to this route of authority to serve points in Ecuador, Bolivia and Paraguay consistent with the bilateral air services agreements between those countries and the U.S.

Continental urges the Department to identify additional U.S.-South America route opportunities, invite applications from all interested carriers and defer, dismiss or deny United's application in the meantime.

Answer of Delta Air Lines to Amendment No. 2 to Application of United Air Lines

Both the United and Delta requests are generally consistent with the applicable bilateral agreements; however, in some instances designation and/or frequency limitations may apply to U.S. carrier services. To the extent that the Department concludes that the two applications in Dockets OST-97-3218 and OST-95-495 are mutually exclusive, the Department should consolidate the mutually exclusive portions of the applications for contemporaneous consideration.

United has on file in the above-captioned dockets applications for certificates of public convenience and necessity or for amendments to existing certificates for various countries for which it holds current temporary exemption authority. A list of those countries and the corresponding dockets containing the certificate application and current temporary exemption authority is attached hereto as Exhibit A. United also has on file certificate applications for various countries associated with applications for exemption authority that were never granted for reasons that have never been explained. A list of those countries and the corresponding dockets containing the pending certificate and exemption applications is attached as Exhibit B. As United's applications have been pending before the Department for varying periods of time, some as long as thirteen years, United hereby requests that the Department act immediately on its pending applications for those countries listed in Exhibits A and B in accordance with the procedures set out in the Notice.
