Application for Renewal and Amendment of its Temporary Exemption to Operate Scheduled and Charter Service between the United States and Mexico (a) To renew all of its exemption authority as renewed by Order 96-1-45 dated August 28, 1995, for a period of at least one year; and (b) grant Aeromar an exemption to operate scheduled services in the following additional markets: (i) San Antonio--Manzanillo (ZLO) (ii) Houston (IAH) -- Monterrey (MTY)/Puebla (iii) (PBC)/Queretaro (QRO).

Aeromar is currently operating transborder flights between San Antonio, Texas (SAT), and San Luis Potosi/Guadalajara, Mexico. Aeromar plans to continue those services and intends to institute passenger and/or all-cargo services in the SAT-Puerta Vallarta (PVR) market in the near term and San Antonio – Saltillo later this year. For flexibility to respond to demand, Aeromar seeks renewal of those San Antonio segments where it may not operate direct service in 2000. Nonstop service between Puebla and Houston and Queretaro - Houston with Aeromar-operated aircraft is planned for the fourth quarter of 2000. Aeromar seeks the necessary authority so that it can code share on Aeromexico-operated flights on this segment and thus offer single carrier service from Queretaro and Puebla to Houston with a stop and plane change in Monterrey.

Aeromar is currently operating transborder flights between Laredo, Texas, and Mexico City, Mexico, on a non stop basis. Mexicana code shares with Aeromar on that flight. Aeromar plans to continue those services. Aeromar may operate a code-share flight with Mexicana in the Mexico City - Laredo, Texas, market. For flexibility to respond to demand, Aeromar seeks renewal of all segments where it may not be operating direct service in 2003.

Aeromar also applies to add Mexico City - San Antonio to this exemption. Aeromar has been designated for this route by its government.

Application of Aeromar for Renewal and Amendment of Its Temporary Section 40109(c) Exemptio to Operate Scheduled and Charter Service Between the United States and Mexico - Application of Aeromexico for a Codeshare Statement of Authorization

Aeromar is currently operating transborder flights between San Antonio, Texas; and San Luis Potosi, and Mexico City, Mexico. For flexibility to respond to demand, Aeromar seeks renewal of all authorized segments -- even where it may not be operating direct service in 2005. Aeromar will be using ATR-42 commuter size aircraft.

As shown in the attached designation from the Mexican DGAC, Aeromar had been designated as the non-operating code share partner with Aeromexico between Mexico City, on the one hand, and the co-terminal points Atlanta, GA; Miami, FL; Houston, TX; and New York/JFK. Aeromar desires to begin placing its code on Aeromexico flights in these markets as soon as possible. To operate its flights with Aeromar placing its code on Aeromexico, Aeromexico needs a statement of authorization. The Mexican DGAC has authorized Aeromexico and Aeromar to code share in these markets.

Part 212. Application for Renewal and Amendment of its Temporary Exemption to Operate Scheduled and Charter Service Between the United States and Mexico

Aeromar is currently operating transborder flights between San Antonio, Texas; and San Luis Potosi, and Mexico City, Mexico. For flexibility to respond to demand, Aeromar seeks renewal of all authorized segments -- even where it may not be operating direct service in 2005-2006.

Aeromar has recently received authority from the Government of Mexico to operate scheduled service between Monterry, Mexico and Corpus Christi, TX; Reynosa, Mexico, and Corpus Christi, TX; and Reynosa, Mexico, and San Antonio, Texas. Aeromar desires to begin this service on November 15, 2005. These services will be new and in addition to the flights currently being operated.

Aeromar plans to operate two roundtrips per week between Reynosa and Corpus Christi; two roundtrips per week between Reynosa and San Antonio; and two roundtrips per week between Monterrey and Corpus Christi. Aeromar will use its ATR-42 commuter size aircraft on these routes.

Application for Renewal and Amendment of Its Temporary Section 40109(c) Exemption to Operate Scheduled and Charter Service

Renew its §40109(c) exemption to engage in scheduled service and charter services (as renewed in Notice of Action taken June 22, 2005) for a period of at least one year; Aeromar invokes the provisions of Part 377 of the Department's Regulations for the automatic extension of all of its previously issued and unexpired exemption licenses.

Authorize it to operate as a code share partner with Aeromexico in the MEX-HOU/ATL/JFK/EVR/MIA markets. Issue a renewed statement of authorization to Aeromexico to carry Aeromar's code on the flights Aeromexico operates in the Mexico City - Houston/JFK/Miami/Atlanta markets in Docket OST-2005--20954.

Aeromar is currently operating transborder flights between San Antonio, Texas; and San Luis Potosi, and Mexico City, Mexico. For flexibility to respond to demand, Aeromar seeks renewal of all authorized segments - even where it may not be operating direct service in 2006. Aeromar will be using ATR-42 commuter size aircraft (46, 48, or 50 seats) and other aircraft that it leases or acquires to operate the services it operates itself. Aeromar operates five ATR-42-320's and eight ATR-42-500's.

Aeromar expects to code share with both Aeromexico and Mexicana on some of these routes for which it is seeking renewal or addition to its exemption.
