Until recently, TACV was the only carrier offering to provide or expressing interest in providing the foregoing services, and, at present, South African Airways is the only other carrier providing air services between the U.S. and Cape Verde (on its flights between the U.S. and South Africa). TACV believes that the Government of Cape Verde would extend reciprocal rights to authorized U.S. air carriers to operate service to the Republic of Cape Verde should an application for such service be made.

TACV seeks renewal of authorization to perform scheduled foreign air transportation services to transport persons, property and mail as follows: Between Cape Verde and Boston, Massachusetts, at a frequency of one round trip per week, subject to the requirement that TACV conduct this service with aircraft wet-leased from an authorized U.S. air carrier or foreign air carrier. TACV has been providing Sal-Boston service since March, 1987 under Notice of Action Taken issued November 18, 1998, effective until November 18, 1999, and under prior exemption Orders.  TACV is not yet in a position to conduct such service with its own aircraft and thus must rely upon wet-leased aircraft of other carriers for its Boston-Sal service.  Until recently, TACV was the only carrier offering to provide or expressing interest in providing the foregoing services, and, at present, South African Airways is the only other carrier providing air services between the U.S. and Cape Verde (on its flights between the U.S. and South Africa). TACV believes that the Government of Cape Verde would extend reciprocal rights to authorized U.S. air carriers to operate service to the Republic of Cape Verde should an application for such service be made.

TACV advises that on August 7, 1999, a Cape Verde Coast Guard Dornier 228 aircraft approaching Ponta do Sol airfield on Santo Antao Island, Republic of Cape Verde, had an accident during adverse weather conditions in which 16 passenger and two crew members died. The cause of the accident is under investigation by the Civil Aviation Authority of the Republic of Cape Verde.

TACV has been providing Sal-Boston service since March, 1987 under Notice of Action Taken issued March 29, 2000, effective until March 29, 2001, and under prior exemption Orders.

Until recently, TACV was the only carrier offering to provide or expressing interest in providing the foregoing services, and, at present, South African Airways is the only other carrier providing air services between the U.S. and Cape Verde (on its flights between the U.S. and South Africa). TACV believes that the Government of Cape Verde would extend reciprocal rights to authorized U.S. air carriers to operate service to the Republic of Cape Verde should an application for such service be made.

There is a significant population of persons of Cape Verdian origin in the Southern New England and Eastern United States area. Continuation of TACV's services is therefore consistent with the public interest in that it provides convenient foreign air transportation services that would not otherwise be available to both U.S. and other nationals. Successful operation of the Boston-Sal service since 1987 has shown it to be of great public benefit to the U.S. and Cape Verde and their citizens and residents.

Application of Transportes Aereos de Cabo Verde d/b/a TACV, pursuant to 49 USC 40109, requests amendment of its exemption from 49 USC 41301 to the extent necessary to allow TACV to provide once weekly scheduled foreign air transportation of person, property and mail between Ilha do Sal Cape Verde (SID) and New York (JFK or EWR) using aircraft wet leased from any authorized U.S. or foreign air carrier, in addition to continuing to provide presently DOT-authorized, once weekly air transportation services between Ilha do Sal, Cape Verde and Boston, Massachusetts. TACV requests authority to commence Sal-New York service beginning June 19, 2002.

TACV is not yet in a position to conduct such service with its own aircraft and thus must rely upon wet-leased aircraft of other carriers for its Sal-Boston and Sal­New York service. For the immediately planned Sal-New York flights, TACV plans to use Air Luxor, an FAA Part 129 certificated air carrier, to serve as wet lessor with an L-1011-500 aircraft, beginning June 19, 2002.

TACV has been providing Sal-Boston service since March, 1987 under Notice of Action Taken issued May 28, 2002, effective until May 28, 2003, and under prior exemption Orders. TACV has been providing Sal-New York service since June 17, 2002, pursuant to Notice of Action Taken issued May 28, 2002.

Until recently, TACV was the only carrier offering to provide or expressing interest in providing the foregoing services. And at present, South African Airways is the only other carrier providing any air services between the U.S. and Cape Verde ( and, since January 2003, that Cape Verde-U.S. service is inbound only). TACV believes that the Government of Cape Verde, as it has in the past, would extend reciprocal rights to authorized U.S. air carriers to operate service to the Republic of Cape Verde should an application for such service be made.

Application for Amended Exemption and Renewal of Exemption

Hereby respectfully requests amendment of its exemption from 49 U.S.C. § 41301 to the extent necessary to allow TACV to provide scheduled foreign air transportation of persons, property and mail, without frequency limitation, between liha do Sal Cape Verde (SID) and New York (JFK or EWR) and Boston Massachusetts (BOS) on a co-terminal basis, using aircraft wet leased from any authorized U.S. or foreign air carrier.

At present, TACV is the only carrier offering to provide or expressing interest in providing the foregoing services, and, at present, South African Airways is the only other carrier providing any air services between the U.S. and Cape Verde (and since January 2003, that Cape Verde-U.S. service is inbound only).

The Port Authority of New York and New Jersey in Support of the Application for Amdended Exemption and Renewal of Exemption

The Port Authority believes that the service proposed by TACV will maintain an essential link between the United States' largest, most populous metropolitan region, home of the nation's largest financial and banking center to Ilha do Sal. The proposed service will, furthermore, create a link essential for those airlines and airports in Africa which do not have the resources to have direct service to our region. New York/New Jersey is home to a large Portuguese speaking population. many with Cape Verde ties. TACV had provided SID-JFK service for almost one year until April 28. 2003 when it stopped operating to our region. That service had been started almost immediately before the governments of the U.S. and the Republic of Cape Verde initialed an Open Skies aviation bilateral agreement.

The New York/New Jersey region is the largest origin-and-destination passenger and cargo market in the nation. Additionally, the development of an increased domestic service network at Kennedy achieved in the past two years, and expected to be expanded in the very near future, dyes a significant feeder and distribution potential with approximately 272 non-stop flights to 50 points in the U.S. served from that airport alone. The potential is further expanded if we add the markets served by LaGuardia (540 non-stop flights to 66 points) and Newark Liberty International (545 non-stop flights to 79 points.)

Since TACV is the only carrier providing or expressing interest in providing the aforementioned service, U.S. DOT acceptance of this exemption will allow expected travel of relevant businesses and of financial concerns, as well as visiting family and relatives ("VFR") type traffic to take place.
