American has continuously operated nonstop service between the United States and Brazil since 1990. American presently operates the following pattern of service in the New York/Miami-Rio de Janeiro/Sao Paulo markets:
American also notes that it has filed two other applications that, if granted, would result in broad U.S.-Brazil certificate authority, and obviate the need for specific authority between New York/Miami and Rio de Janeiro/Sao Paulo. See Docket 48301 (application filed August 18, 1992); Docket 48343 (application filed September 10, 1992). American urges the Department to act on these long-pending requests.

In our captioned renewal application for Route 389, submitted on December 11, 2000, the procedural notice on the cover page should be changed to read as follows:
"NOTICE: American requests that this application be processed by expedited show-cause procedures under 14 CFR 302.207. Answers supporting or opposing this application are due on January 2, 2001.

Continental does not object to Americans request to renew its New York/Miami-Rio de Janeiro/São Paulo certificate authority, but the Department should not grant Americans requests for broad U.S.-Brazil authority unless all carriers designated for Brazil combination services receive the same broad route authority and the same flexibility to move Brazil frequencies without Department approval American has.

Order 2001-5-26 amends/issues in the form attached, certificates of public convenience and necessity to the applicants listed in the caption of this order. The order renews, for indefinite duration, the allocation of six weekly frequencies to American Airlines to conduct its San Jose- Tokyo operations The allocation of frequencies is subject to the condition that any frequencies not used for a period of 90 days will revert automatically to the Department for reallocation, and also grants Continental an allocation of seven weekly frequencies to operate services in the New York/Newark- Cali/Medellin markets. The allocation of frequencies is effective immediately for services commencing no earlier than October 1, 2001, for New York/Newark- Cali service, and no earlier than October 1, 2002, for New York/Newark- Cali- Medellin service

American Airlines, Inc. hereby applies for renewal of segment 4 of its certificate for Route 389, authorizing scheduled foreign air transportation of persons, property and mail between the coterminal points in New York, New York/Newark, New Jersey and Miami, Florida and the coterminal points Rio de Janeiro and Sao Paulo, Brazil. This authority was last renewed by Order 2001-5-26.
