At present, there is no air services agreement between the United States and Kazakhstan, and the prior U.S.-U.S.S.R. Agreement of 1990 does not include service to Almaty. on the basis of comity and reciprocity, the Government of Kazakhstan approved the proposed Northwest/KLM code-share service in November of 1995. Northwest has been providing U.S.-Almaty codeshare service in conjunction with KLM since December 9, 1995.

permit Northwest to provide scheduled combination service between points in the United States and Almaty, Kazakhstan, via Amsterdam. Northwest intends to serve this market pursuant to its code-share agreement with KLM Royal Dutch Airlines.  At present, there is no air services agreement between the United States and Kazakhstan, and the prior U.S. -U.S.S.R. Agreement of 1990 does not include service to Almaty. The Government of Kazakhstan approved Northwest's code-share operations in December 1995 on the basis of comity and reciprocity. While the Kazhakstan Transport Ministry subsequently requested that Northwest cease its code-share operations, Northwest understands that Kazakhstan officials are in the process of reviewing an open skies agreement with the United States and may in the meantime be willing to permit resumption of third-country code-share services on a comity and reciprocity basis.

United requests leave to file this answer after the due date for answers has passed. It just recently came to United's attention that the government of Kazakhstan may be discriminatorily administering code-share authorizations.  Northwest states in its renewal application that it now "understands that Kazakhstan officials are in the process of reviewing an open skies agreement with the United States and may in the meantime be willing to permit resumption of third-country code-share services on a comity and reciprocity basis." Ostensibly pursuant to this new policy, Northwest proposed to resume code-share services between Amsterdam and Almaty on July 3 1, 1999. If Kazakhstan is prepared to permit third-country code shares, this should be done on a non-discriminatory basis. United is concerned that the government of Kazakhstan may be prepared to permit only those U.S. carriers to code share to Kazakhstan whose foreign partners enter into cooperative agreements with Air Kazakhstan. Northwest's partner, KIM, has entered into such an arrangement under which Air Kazakhstan does not itself serve Amsterdam but obtains a block of seats on KLM's flights to sell under its own designator code.

Renewal of Northwest's allocation of the three U. S.-Philippines Route 2 combination frequencies at issue here clearly is in the public interest. Northwest has made continuous use of all 19 of its Route 2 U.S. -Philippines frequencies, including the three frequencies for which Northwest herein seeks renewal. Northwest utilizes these three frequencies, to operate three weekly B-747 Detroit Nagoya-Manila combination flights. Northwest's three weekly combination flights, in the Detroit Manila flights, via Nagoya, provide substantial benefits to the traveling and shipping public. Renewal of Northwest's three Route 2 frequencies for Detroit-Nagoya-Manila service is particularly critical in light of the overall reduction in the level of U.S.-Philippines scheduled air transport services being offered to the traveling and shipping public.
