U.S.- Brazil All-Cargo Service Proceeding; Polar Air Cargo, Inc.
| OST-95-316 OST-2000-8445 - Certificate of Public Convenience and Necessity - US-South America All-Cargo |
November 30, 2000 | Application for Polar Air Cargo for Renewal of a Certificate of Public Convenience and Necessity | U.S.- Brazil |
| Service List |
Polar requests the renewal of the authority in its Certificate of Public Convenience and Necessity for Route 696 to engage in foreign air transportation of property and mail between the coterminal points Miami, Florida, and Los Angeles, California; the intermediate points Curacao, Netherlands Antilles; Santiago, Chile; Barranquilla, Colombia; and Panama City, Panama; and the coterminal points Manaus, Rio de Janeiro, and Sdo Paulo, Brazil. Polar holds a Certificate of Public Convenience and Necessity for Route 696, which authorizes Polar to operate as described above. This authority was granted by Order 96-6-12 pursuant to the aviation agreement between the U.S. and Brazil. The Department granted the authority for the usual five year period for limited-entry markets. The authority will expire on June 5, 2001. Polar also requests that it be authorized to serve the points in Brazil so authorized in conjunction with points authorized in its other outstanding certificates of public convenience and necessity and exemption authorizations to the extent such service is consistent with applicable international agreements.
Polar presently operates three weekly U.S.-Brazil all-cargo services and will increase its operations to four weekly in January 2001 .

Application for Renewal of a Certificate of Public Convenience and Necessity | Word
Hereby requests renewal of its Experimental Certificate of Public Conve-nience and Necessity for Route 626, authorizing it to provide scheduled foreign air transportation of property and mail between the coterminal points Miami, Florida and Los Angeles, California; the intermediate points Curacao, Netherlands Antilles; Santiago, Chile, Barranquilla, Colombia; and Panama City, Panama; and the coterminal points Manaus, Rio de Janeiro and Sao Paulo, Brazil. Polar would also ask that the certificate be renewed for a minimum of five years.
The Brazil and other South American authority contained in Polar’s Experimental Certificate of Public Convenience and Necessity for Route 696 provides the basis for an important part of Polar’s global air service network. Polar requires the rights conferred by that certificate in order to preserve maximum flexibility in its ongoing operations and thus seeks renewal herein.

Order Transferring Exemption Authority and Reissuing Certificates
We have decided to approve the transfer of Polar's foreign certificate and other authorities to Polar Worldwide. However, we will not here transfer Polar's interstate authority. As noted above, by Order 2007-3-15, the Department issued to Polar Worldwide an interstate certificate of public convenience and necessity to conduct scheduled air transportation of property and mail. Therefore, Polar's request for the transfer of its interstate certificate to Polar Worldwide is now moot. We will cancel Polar's interstate certificate upon the effectiveness of Polar Worldwide's interstate certificate (see Order 2007-3-15).
