AeroUnion was formed in order to serve as a Mexican-flag, inter­-American wide-body all-cargo air carrier to operate flights from Mexico to the U.S., as well as from Mexico to Canada, and points in Latin America using Airbus A-300-B4 freighter equipment. The overwhelming majority of U.S.-Mexico all-cargo lift is provided by U.S.-flag all-cargo carriers (e.g. Fed Ex, UPS, Emery, Amerijet, DHL, plus numerous U.S.-flag charter operations). AeroUnion will provide additional dedicated A­300-B4 all-cargo services between Mexico and the U.S. by offering shippers in the proposed markets a Mexican-flag, wide-body carrier option in this market. Grant of this application is therefore in the public interest.

AeroUnion plans to initiate U.S. operations with an A-300-B4 freighter in all-cargo configuration. AeroUnion plans to initially operate from Mexico City, Monterrey, and Guadalajara, Mexico to U.S. points including: Dayton, OH; New York, NY; Detroit, MI; and Los Angeles, CA.

AeroUnion hereby applies for renewal of its exemption authority from 49 U.S.C. 41301 to engage in all-cargo charter operations between a point or points in Mexico, on the one hand, and a point or points in the United States, on the other hand. AeroUnion also requests renewal of authority to operate charters pursuant to 14 C.F.R. 212 of the Department’s regulations.

By a Notice of Action Taken dated May 30, 2006, AeroUnion was granted renewal of its all-cargo charter exemption authority for a period of one year, and will, therefore, expire by its own terms on May 30, 2007. AeroUnion requests that its authority to conduct all-cargo charter service be extended by a year.

See, e.g., Order 1991-5-25, where the Department placed this condition on the foreign air carrier permit granted to Aerovias de Mexico, S.A. de C.V. We note, however, that the Department has granted blanket exemption authority to existing and future Mexican carriers, relieving them of this prior approval requirement for third and fourth freedom charter operations if they submit to the Department advance notice of their charter operations as described in Orders 1998-4-2 and 1999-7-23.
