Notice of Action Taken All- Cargo Services Beyond the U.K.

Scheduled al1-cargo services beyond the United Kingdom with local (fifth-freedom) traffic rights.

Remarks: Under the provisions of the Air Services Agreement between the United States and the United Kingdom, the United States may authorize three airlines serving the U.S.-U.K. market to operate scheduled all-cargo services beyond the UK with local (fifth-freedom) traffic rights. The other two carriers that are currently authorized to use such beyond rights besides Polar are United Parcel Service and Federal Express.
This authority will give Polar the flexibility to continue using valuable fifth-freedom rights available under the U.S.-U.K. Air Services Agreement, as well as fifth-freedom rights that may be granted on an extra-bilateral basis by the U.K. government.

The Department initially selected Polar to exercise this authority in the U.K. Fifth-Freedom All-Cargo Proceeding, Order 1996-1-26.  Polar has utilized this authority continuously and desires to retain its right to do so.  Accordingly, Polar is applying for renewal of its authority.

Polar Air, Cargo, Inc. requests renewal of its designation to exercise fifth-freedom traffic rights for all-cargo services beyond the United Kingdom under the U.S.-U.K. Air Services Agreement.  Polar requests that this authority be granted for a minimum of five years.

Renewal of scheduled all-cargo services beyond the United Kingdom with local (fifth-freedom) traffic rights.

By Order 1996-1-26, the Department selected Polar to receive a designation to exercise fifth-freedom traffic rights for all-cargo services beyond the UK under the U.S.-U.K. Air Services Agreement. This authority was granted for a period of five years and renewed for an additional five years, until it expired January 10, 2006.  See Notice of Action Taken issued January 10, 2001, in the present docket.  Polar filed a timely application for renewal of this authority, and the authority has been kept in force by virtue of 5 U.S.C. § 558(c) and 14 CFR Part 377 pending our action on the renewal request.
