AJX is wholly owned by All Nippon Airways Co., Ltd. and subsidiaries of ANA and is a corporation organized and existing under the laws of Japan.
AJX plans to begin scheduled combination service on or about January 1, 2001, between Osaka, Japan, and Seoul, Korea. Thereafter, AJX intends to expand to other markets, including the United States, as described below. By this Application, AJX seeks exemption authority in order to conduct scheduled foreign air transportation of persons, property and mail between any point or points in Japan and any point or points in the United States and charter authority, as stated above. Commencing on or about March 25, 2001, AJX plans to provide daily scheduled combination service between Osaka and Guam, using Boeing 767-300 aircraft. In 2002, AJX plans to expand its U.S. service and institute scheduled combination service between Osaka and Honolulu. AJX may wish to conduct codeshare operations with a U.S. carrier or carriers in the U.S.-Japan and other markets and will file the appropriate applications for statements of authorization in connection therewith.
AJX's fleet consists of eight Boeing 767-300 aircraft. AJX leases each of these aircraft from ANA.

Exemption from 49 U.S.C. § 41301 to engage in scheduled foreign air transportation of persons, property and mail between any point or points in Japan and any point or points in the United States; and to conduct charters in accordance with Part 212 of our rules.
Based on the record in this case, we found that Air Japan is financially and operationally qualified to perform the services authorized above. In addition, we found that Air Japan is substantially owned and effectively controlled by Japanese citizens. Specifically, Air Japan is 78 % owned by All Nippon Airways (ANA), a foreign air carrier of Japan. The remaining shares of Air Japan are held by ANA subsidiary companies. All of Air Japan's stockholders and chief management personnel are citizens of Japan. Air Japan is properly licensed and designated by the Government of Japan to perform the proposed services. By memorandum dated February 20, 2001, the FAA advised us that it knew of no reason why we should act unfavorably on Air Japan's application.

Application to Amend an Exemption and Statement of Authorization
Pursuant to 49 U.S.C. § 40109, Subpart C of the Department's Procedural Regulations and 14 C.F.R. Part 212, Air Japan Co., Ltd. hereby applies for (a) an amendment of its existing exemption authority in Docket OST-2000-8299, to the extent necessary to enable AJX to provide U.S. carrier code-share services on flights operated by AJX between points in Japan and points beyond Japan, in connection with U.S. carrier services between the United States and points beyond Japan, via Japan, and (b) an amendment of its existing statement of authorization in Docket OST-2002-13473, to the extent necessary for AJX to display the UA* designator code of United Air Lines on AJX flights between points in Japan and points beyond Japan.
AJX and United now wish to expand their code-share service to include codesharing on AJX flights between Japan and points in third countries beyond Japan, on a blindsector basis. Initially, AJX and United plan to display the UA* code on AJX daily round-trip flights between Tokyo and Seoul, Korea, commencing on or about November 1, 2003. United will not carry local traffic under its code between Tokyo and Seoul.

Application for Renewal of Exemption
Hereby requests a renewal of its exemption from 49 U.S.C. § 41301 granted in this docket. AJX requests a renewal of the exemption for not less than a one-year period. On October 8, 2003, the Department granted AJX ' s request to amend its exemption authority "to the extent necessary to enable Air Japan to provide U.S. carrier code-share services on flights operated by Air Japan between points in Japan and points beyond Japan, in connection with U.S. carrier services between the United States and points beyond Japan, via Japan." Notice of Action Taken, October 8, 2003. This authority was made "coextensive with AJX' s underlying authority in this docket." AJX's exemption authority, as amended, expires on March 17, 2004.
