On or about March 25, 2001, Delta plans to introduce new codeshare service to several Eastern and Central European destinations in conjunction with its codeshare partner, Czech Airlines. On October 27, 2000, Delta and CSA filed a joint application seeking a blanket statement of authorization that would allow the carriers to implement service under their codesharing agreement. Larnaca, Cyprus, is among the points that Delta proposes initially to serve on a third-country codeshare basis with CSA.

Cyprus Airways strongly opposes approval of Delta’s request prior to approval of
the Joint Application of Cyprus Airways and Northwest Airlines, Inc. filed November 2, 1999, in Docket OST 99-6437. Since submission of that unopposed application, the Department approved over Cyprus Airways’ objection United Air Lines’ request for an exemption permitting it to operate to Larnaca under a codeshare arrangement with Lufthansa, citing favorable aviation relations between the United States and Cyprus. Pending before the Department is American Airlines’ application to serve Cyprus through a codeshare arrangement with Swissair. Delta now seeks authority to enter the market as the third U.S. carrier, while Cyprus Airways and Northwest are compelled to wait. Cyprus Airways was the only party to file an answer to Delta’s exemption application, and that carrier has not raised any objection on the merits or public interest criteria supporting approval of Delta’s application. Rather, the only basis for Cyprus Airways’ objection is the delay in approval of its own application to provide similar U.S.-Cyprus codeshare services in conjunction with Northwest. This delay appears to be entailed by the new FAA/DOT policy requiring a safety audit review prior to the approval of new codeshare services.
Delta sympathizes with Cyprus Airways’ concerns regarding this extremely slow review process. For its part, Delta has outstanding requests for non-controversial codeshare authority, some of which have been delayed for months solely because of this issue. Delta urges the Department and the FAA to work together to streamline this process as quickly as possible, so that non-controversial codeshare applications, which are in the public interest, can be approved without undue delay.
However, because the safety and operational concerns affecting each codeshare partnership are different, Delta does not believe that withholding authority to one carrier, based on the safety audit considerations of another, is justified. Delta did not oppose the Cyprus Airways/Northwest application, and, because the applications are not competing or mutually exclusive, both should be approved as quickly as possible and without regard to one another.

Delta also requests continuation of its authority to combine services operated under these exemptions with all other Delta services authorized by its existing certificates and exemptions, to the extent permitted by applicable international agreements.

Application for Renewal of Exemptions
Hereby applies under 49 U.S.C. § 40109 for renewal of Delta's exemption authorities to engage in scheduled foreign air transportation of persons, property, and mail between the United States and each of the points identified in Exhibit A. Delta also requests continuation of its authority to combine services operated under these exemptions with all other Delta services authorized by its existing certificates and exemptions, to the extent permitted by applicable international agreements.
Pursuant to these exemptions, Delta provides bilateral, third-country and intra-country codeshare service between the United States and numerous foreign points in conjunction with SkyTeam alliance partners Societe Air France, Alitalia-Linee Aeree Italiane- S.p. A., Czech Airlines, and Korean Air Lines Co., Ltd., and codeshare partners Royal Air Maroc, China Southern Airlines Company Limited, and Jersey European Airways (UK) Limited, trading as FlyBE.
In addition, on May 11, 2000, Delta filed a renewal application for its exemption authority to serve additional points in Europe, Africa and Asia on a third-country codeshare basis (Dockets OST-96-1598 and OST-96-1510); on June 20, 2003, Delta filed a renewal application for its exemption authority to serve Vietnam on a third-country codeshare basis (Docket OST-2000-7078); and on October 14, 2003, Delta filed a renewal application for its exemption authority to serve Portugal (Docket OST-99-6721). These applications remain pending. Delta urges the Department to grant renewal of these applications concurrently and coextensively with the authority requested herein, for the same administrative efficiency reasons.
