Exemption to authorize Air Comet to provide scheduled foreign air transportation of persons, property, and mail between Spain and New York. Air Comet proposes to begin these services upon grant of this authority, and requests that the exemption authority remain in effect until the earlier of one year from its date of issuance or the effective date of corresponding permit authority for which Air Comet intends to apply.

Hereby applies for an exemption from 49 U.S.C. Section 41301, to enable it to conduct scheduled foreign air transportation of persons, property, and mail between points in the Kingdom of Spain and New York, New York. By Notices of Action taken in Docket OST-2000-7896 issued November 21, 2001, and January 3, 2003, the Department approved Air Comet's applications for exemption from 49 U.S.C. §41301 to engage in scheduled foreign air transportation of persons, property and mail between Spain and New York, New York. Air Comet inadvertently allowed this scheduled authority to lapse.

Hereby applies for an exemption from 49 U.S.C. Section 41301, to enable it to conduct scheduled foreign air transportation of persons, property, and mail between points in the Kingdom of Spain and New York, New York.
On December 6, 2004 in Docket OST-2004-19850, Air Comet filed the Application of Air Comet S.A. for Renewal of its Permit to Perform Charter Foreign Air Transportation. Air Comet invoked the automatic extension provisions of the Administrative Procedure Act, and to date no final action by the Department has been taken.

Air Comet hereby applies for a one-year renewal of its exemption from 49 USC Section 41301, from April 21, 2006 to April 21, 2007, to enable it to conduct scheduled foreign air transportation of persons, property and mail between points in the Kingdom of Spain and New York, New York.
By Order 1999-12-9 in Docket OST-1997-2996 the Department granted Air Comet a foreign air carrier permit under §41301 of Title 49 of the U.S. Code to perform charter foreign air transportation of persons, property, and mail between Spain and the United States, and other charters subject to Part 212 of the Department's Rules which would have expired on December 8, 2004. On December 6, 2004, in Docket OST-2004-19850, Air Comet applied for a Renewal of its Permit to Perform Charter Foreign Air Transportation. Air Comet invoked the automatic extension provisions of the Administrative Procedure Act pending final action of the Department on the application. That application is still under consideration by the Department. The application to renew Air Comet's Foreign Charter authority was modified by Air Comet's application to add to the permit renewal, a request to grant Air Comet a permit to conduct scheduled foreign air transportation. See Air Comet's March 11, 2005, and April 14, 2005 filings in Docket OST-2004-19850. As stated above, the application for renewal of Air Comet's charter permit and its initial request for a permit for scheduled authority is still pending decision of the Department

Order Granting Exemption and To Show Cause
By application dated December 6, 2004, as amended March 11, 2005, and supplemented April 14, 2005, Air Comet requests that we renew its existing foreign air carrier permit, issued by Order 1999-12-9, which authorizes the carrier to engage in charter foreign air transportation of persons, property and mail between Spain and the United States, and to conduct other charters in accordance with 14 CFR Part 212. In addition to renewing this authority, Air Comet requests that we amend its permit to authorize it to engage in scheduled foreign air transportation of persons, property and mail between a point or points in Spain, on the one hand, and New York, New York, on the other hand. Air Comet requests that we grant this renewed and amended permit for an indefinite period, coextensive with the bilateral aviation agreement between the United States and Spain.
