Cyprus Airways has no comment on the merits of American's application. However, it objects strongly to approval of American's request prior to approval of the Joint Application of Cyprus Airways and Northwest Airlines, Inc. filed November 2, 1999, in Docket OST 99-6437. That unopposed application has been before the Department of Transportation for nearly ten months, far beyond the proposed December 15, 1999, commencement date. During this time, the Department approved United Air Lines' request for an exemption permitting it to operate to Lamaca through a codeshare arrangement with Lufthansa, citing favorable aviation relations between the United States and Cyprus as the basis for approval.

Hereby applies for renewal of its exemption granted by Notice of Action in this docket on March 2, 2001, authorizing foreign air transportation of persons, property, and mail between points in the United States and points in Cyprus, with the right to integrate such authority with American's existing certificates and exemptions, consistent with applicable international agreements.  American obtained U.S.-Cyprus authority in order to conduct codesharing operations with Swissair. That arrangement was terminated last year. American now intends to use the authority for codesharing services with British Airways, via London, pursuant to the American/British Airways blanket codesharing application submitted on November 18, 2002 in OST­2002-13861.

American has applied for "renewal" of its authority to provide codeshare service between the U.S. and Cyprus. American is not asking to renew its authority to codeshare with Swissair or seeking authority with Swissair's successor; American is instead seeking new authority to codeshare with British Airways between the U.S. and Cyprus. Continental would not object to the award of U.S.-Cyprus authority to American for its own flights, but Continental does object to the award of such authority to American for codesharing with British Airways prior to the availability of unredacted copies of the American/British Airways agreements in Docket OST-2002-13861 and a thorough review of the American/British Airways application based on complete information about their relationship.
