American Airlines, Inc., under 14 CFR Part 212, hereby applies for a statement of authorization to engage in the following additional codesharing services with The TACA Group carriers TACA International Airlines S.A. (TA) and Lineas Aereas Costarricenses S.A. (LR):

American and The TACA Group were authorized to engage in certain reciprocal codesharing services by Order 98-5-26, May 20, 1998. The statements of authorization granted by that order were made subject to a condition that "codeshare services in any city-pair markets not listed in the July 8, 1996 application will require an appropriately-filed new application"

The additional cities at Los Angeles reflect a recent expansion of American's services at that city which did not exist in 1996. Dallas/Ft. Worth-New Orleans was apparently inadvertently omitted from the 1996 list. The requested statement of authorization for these additional city-pairs is fully consistent with the open skies agreements between the United States and El Salvador and between the United States and Costa Rica, and should be immediately granted in the public interest.

American Airlines, Inc. et al., and The TACA Group Reciprocal Code-Share Services Proceeding

American and the TACA Group already provide more U.S.-Central America service than any other airline or combination of airlines, and they continue to dominate the critical Miami gateway. Allowing American to display codes of TACA Group members between the Dallas/Ft. Worth and Los Angeles gateways, which they already dominate, and additional U.S. points would spread the anticompetitive effects of the American/TACA Group codeshare alliance to more U.S. points beyond American's U.S. international gateways and increase the harm to the traveling and shipping public. Moreover, the proposed codesharing would be fully horizontal and not produce any meaningful public benefits since American already offers online Central America service between each of the U.S. points American proposes for additional codesharing with the TACA Group. Under these circumstances, the risks to competition are high and the public benefits are minimal. For these reasons, the Department should deny American's request.

American and TACA's "renewal" application seeks to eliminate substantially all of the necessary competitive safeguards that the Department insisted upon to try and mitigate the anticompetitive effects of this unhealthy codeshare arrangement. Moreover, the Department specifically stated that TACA's failure to enter into a competitive codeshare agreement with another U.S. airline - which TACA has not done would be considered a negative factor in deciding whether the American/TACA arrangement should be renewed.

Motion for Leave to File and Surreply of American Airlines

In its application, American has asked for code-sharing authority with The TACA Group beyond Los Angeles to Colorado Springs, Denver, Oakland, Phoenix, Reno, San Francisco, and San Jose, and beyond Dallas/Ft. Worth to New Orleans. The additional cities at Los Angeles reflect a recent expansion of American's services at that city which did not exist in 1996, whereas Dallas/Ft. Worth-New Orleans was apparently inadvertently omitted from American's 1996 application. The requested authority is fully consistent with the open skies agreements between the United States and El Salvador and between the United States and Costa Rica, and with the public interest.

The Department should also reject Continental's and Delta's position that this matter be consolidated with the American/TACA Group codeshare renewal application pending in OST-96-1700, or the American/TACA Group antitrust immunity application pending in OST-00-7088. By taking such a position, Continental and Delta are simply seeking an unwarranted delay in the grant of codesharing rights to American and The TACA Group that are guaranteed by the U.S.-El Salvador and U.S.-Costa Rica open skies agreements, and that are fully consistent with Order 98-5-26.
