Continental intends to offer weekly nonstop B-737 New York/Newark-Acapulco, Puerto Vallarta and San Jose del Cabo, Mexico service beginning in December 2000. Granting Continental the authority requested clearly serves the public interest. No other U.S. airline offers nonstop service in any of the city-pairs in which authority is sought, and the proposed flights will offer travelers and shippers options via Continental's hub at Newark International Airport which would otherwise be unavailable to them. The U.S.-Mexico Air Transport Agreement authorizes service between New York/Newark and the Mexican points at issue by two airlines of each country, and Mexican carriers and their U.S. codeshare partners will also be free to offer services on these routes if they decide to do so.

Applies for renewal of its exemption from 49 U.S.C. §41102 authorizing Continental to provide scheduled foreign air transportation of persons, property and mail between New York/Newark and Acapulco, Puerto Vallarta and San Jose del Cabo, Mexico on a seasonal basis for a period of no less than two years or until the Department acts on Continental's request to amend its Route 561 certificate to include a New York/Newark-Acapulco/Puerto Vallarta/San Jose del Cabo segment. Continental applies pursuant to 49 U.S.C. § 40109 and Subpart C of the Department's Rules of Practice for renewal of its exemption from 49 U.S.C. §41101 authorizing Continental to provide scheduled foreign air transportation of persons, property and mail between New York/Newark and Acapulco, Puerto Vallarta and San Jose del Cabo, Mexico, on a seasonal basis for a period of no less than two years or until the Department acts on Continental's request to amend its Route 561 certificate to include New York/Newark-Acapulco, Puerto Vallarta and San Jose del Cabo segments, whichever is later.

Continental applied for an amendment to Continental's Route 561 certificate to add New York/Newark-Acapulco/Puerto Vallarta/San Jose del Cabo authority in Docket OST-2002-11894 on March 20, 2002.
Absent renewal, Continental's New York/Newark-Acapulco/Puerto Vallarta/San Jose del Cabo exemption will expire on March 31, 2008.
