If this application is granted, Atlas proposes initially to operate one weekly all-cargo round trip between Miami and Quito and/or Guayaquil, serving Bogota as an intermediate point. Every other week, Atlas will operate a second round trip over the same routing. The operations will be conducted with B-747-200 and/or B-747-400 aircraft capable of carrying up to 248,000 pounds of cargo. As B-747 aircraft are counted as two narrow-body aircraft, Atlas' service proposal is the maximum it could currently operate under the agreement.

Evergreen International Airlines, Inc. hereby answers in opposition to the application of Atlas Air for (1) an exemption pursuant to 49 U.S.C. §40109 authorizing it to provide scheduled foreign air transportation of property and mail between: Miami, Florida and the co-terminals Guayaquil and Quito, Ecuador, via Bogota, Colombia and (2) reallocation to Atlas of the three narrow-body all-cargo frequencies formerly held by Kitty Hawk International.
On May 8, 2000, Evergreen applied in Docket OST-00-7343 for an exemption to provide scheduled all-cargo service to Ecuador and for reallocation of two of the three narrow-body frequencies held by Kitty Hawk. on May 23, 2000 Atlas Air filed its instant application and an answer opposing Evergreen's application in favor of Atlas'.
Contemporaneous herewith, Evergreen is filing a consolidated reply to answers to its application in Docket OST-00-7343 in which it shows why the Department should grant Evergreen's application and deny the Atlas application. Rather than repeat those matters in this answer, Evergreen incorporates them by reference in support of this answer in opposition. For the reasons stated there, Evergreen urges the Department to grant the Evergreen application.

U.S.- Ecuador All Cargo Frequency Allocations

Under the Air Transport Agreement between the United States and Ecuador, U.S. all-cargo carriers may operate a maximum of 15 round-trip all-cargo frequencies per week over the routes specified in the annex of the agreement, using narrow-body aircraft or their wide-body equivalent.. Frequency allocations for U.S. carriers are as follows (based on narrow-body aircraft): Challenge, 7; Arrow Air, 3; Fine Airlines, 2; and Kitty Hawk International, 3. In a submission in Docket OST-2000-7343, Kitty Hawk states that it "has recently ceased active operations and has filed for protection pursuant to Chapter I I of the United States Bankruptcy code," has no intention of reentering the Ecuador market and does not object to reallocation of its frequencies to another carrier. Three U.S. carriers--Evergreen International Airlines, Atlas Air, Inc., and Gemini Air Cargo-have filed applications with the Department for reallocation of Kitty Hawk's frequencies. In addition, Amerijet International has indicated that it is interested in the Ecuador market. (See answer of Amerijet in Docket OST-2000-7343.) The Department has also received several informal inquiries from other carriers indicating interest in serving this market. It is our desire to enable interested carriers to use these opportunities as soon as possible. Before we decide how to award the available opportunities, to ensure that we have applications from all interested carriers, we request that all other U.S. carriers interested in making use of the available frequencies file applications as specified below with the Department no later than June 22, 2000. Answers to applications should be filed no later than June 27, 2000. Replies to answers should be filed no later than June 30, 2000.
