Aeromexico requests an exemption from 49 USC section 41301 to permit it to provide scheduled foreign air transportation of persons, property and mail, for a period of one year, between Hermosillo, Mexico, and Las Vegas, Nevada. Also, Aeromexico requests a Statement Qf Authorization, under 14 CF.1 Part 212, to display Delta's designator code, for an indefinite period, on flights operated by Aeromexico in the Hermosillo-Las Vegas market. Delta requests an exemption under 49 USC section 40109 to permit it to provide scheduled foreign air transportation of persons, property and mail, for a period of two years, in the Hermosillo-Las Vegas market, only on flights operated by Aeromexico under the code-share agreement in effect between it and Aeromexico, and to combine this exemption authority with all of its existing certificate and exemption authority, consistent will applicable international agreements.
On March 15, 2000, we granted Aeromexico's request for an exemption to conduct scheduled, combination services in the Hermosillo-Las Vegas market (for a period of one year) and deferred action on the remainder of the Aeromexico and Delta requests for authority in this Docket. By this Notice, effective April 6, 2000, we are granting Delta's requests for exemption authority (for a period of two years) and Aeromexico's request for a Statement of Authorization (indefinite duration).

By this application, Aeromexico seeks renewal of its exemption authority to provide service between Hermosillo and Las Vegas. The authority was granted by Notice of Action Taken, dated April 6, 2000, and currently is set to expire on March 15, 2001. Aeromexico currently offers daily MD-80 nonstop service in the market and it desires to renew the authority so that it can continue the service, which provides significant public benefits for travelers. In addition, Aeromexico carries the designator code of Delta Air Lines, Inc., on these flights so that the traveling public has the benefit of transportation alternatives and competition is enhanced.

The U.S.-Mexico transborder exemption authority granted to Delta in the captioned dockets is subject to the dormancy notice requirements set forth in condition 7 of Appendix A of Order 88-10-2. With the exception of the U.S.-Mexico exemption authority granted in Dockets OST-2001-10457, OST-2000-7390, and OST-2000-7022, the U.S.-Mexico exemption authority granted is limited to services provided on a code-share basis only.
Delta does not seek to renew the Los Angeles-Durango exemption authority originally granted in this docket (see Notice of Action Taken dated June 20, 2000). Delta provides seasonal service in the Atlanta-San Jose del Cabo market.

Application for Renewal of Exemption Authority
By this exemption request, Aeromexico seeks to renew its exemption authority to engage in scheduled foreign air transportation of persons, property and mail between Hermosillo and Las Vegas. The exemption authority was last granted by Notice of Action Taken, dated April 5, 2004, and will expire on April 14, 2005.
Although Aeromexico is not currently serving the route, it has done so in the recent past, and it desires to renew the authority for an additional year so that it can reinstate service when traffic conditions warrant.

Application for Renewal of Exemptions
This renewal application encompasses multiple docketed exemptions that Delta relies upon to provide nonstop U.S.-Mexico services either with its own aircraft or pursuant to a codeshare arrangement with Aerovias de Mexico, S.A. de C.V.. The exemptions in the captioned dockets all have renewal application deadlines within the next several months. Delta requests that these exemptions be renewed for a period of at least two years, with a common expiration date, or until 90 days after the Department's final determination on Delta's application for amended certificate authority as it pertains to each of the routes identified herein, filed on November 30, 2004 in Docket OST-1999-6275, whichever occurs earlier. The establishment of a common renewal date will promote administrative efficiency and reduce the burden on Delta and the Department in maintaining these multiple and non-controversial U.S.-Mexico exemption authorities.
Delta is not seeking renewal of its exemption authority for Ft. Lauderdale-Mexico City service in Docket OST-2003-15252 because that route is dormant.
