Aeromexico requests an exemption from 49 USC section 41301 to permit it to provide scheduled foreign air transportation of persons, property and mail, for a period of one year, between: 1) Mexico City, Mexico, and Chicago, Illinois; and 2) Guaymas, Mexico, and Los Angeles, California. Also, Aeromdxico requests a Statement of Authorization, under 14 CFR Part 212, to display Delta's designator code, for an indefinite period, on flights operated by Aeromexico in the Mexico City-Chicago and Guaymas-Los Angeles markets. Delta requests an exemption under 49 USC section 40109 to permit it to provide scheduled foreign air transportation of persons, property and mail, for a period of two years, in the Mexico City-Chicago and Guaymas-Los Angeles markets, only on flights operated by Aeromexico under the code-share agreement in effect between it and Aeromexico, and to combine this exemption authority with all of its existing certificate and exemption authority, consistent will applicable international agreements.

By this application, Aeromexico seeks renewal of its exemption authority to provide service between Mexico City and Chicago, and between Guaymas and Los Angeles. The authority was granted by Notice of Action Taken, dated February 9, 2000, and currently is set to expire on February 9, 2001. Aeromexico is offering round trip nonstop service in the Mexico City-Chicago market on Fridays and Sundays and it desires to continue providing such service in the future. In addition, Aeromexico is carrying the two letter designator code of Delta Air Lines, Inc. on the flights. The service being provided by Aeromexico has generated significant benefits for the traveling public and the code share arrangement has enabled Delta to offer competitive service in the market. Although Aeromexico currently is not serving the Guaymas-Los Angeles market on a direct basis, it intends to institute such service in April 2001.

Application Renewal of Exemptions
This renewal application encompasses multiple docketed exemptions that Delta relies upon to provide nonstop U.S.-Mexico services either with its own aircraft or pursuant to a codeshare arrangement with Aerovias de Mexico, S.A. de C.V. The exemptions in the captioned dockets all have renewal application deadlines within the next several months. Delta requests that these exemptions be renewed for a period of at least two years, with a common expiration date, or until 90 days after the Department's final determination on applications for certificate authority with respect to each route, whichever occurs earlier. The establishment of a common renewal date will promote administrative efficiency and reduce the burden on Delta and the Department in maintaining these multiple and non-controversial U.S.-Mexico exemption authorities.

The U.S.-Mexico transborder exemption authority granted to Delta in the captioned dockets is subject to the dormancy notice requirements set forth in condition 7 of Appendix A of Order 88-10-2. With the exception of the U.S.-Mexico exemption authority granted in Dockets OST-2001-10457, OST-2000-7390, and OST-2000-7022, the U.S.-Mexico exemption authority granted is limited to services provided on a code-share basis only.
Delta does not seek to renew the Los Angeles-Durango exemption authority originally granted in this docket (see Notice of Action Taken dated June 20, 2000). Delta provides seasonal service in the Atlanta-San Jose del Cabo market.

The authority was granted by Notice of Action Taken, dated February 9, 2000, and last renewed by Notice of Action Taken dated April 2, 2004. It currently is set to expire on April 14, 2005.
Although Aeromexico is not currently serving the route, it has done so in the recent past, and it desires to renew the authority for an additional year so that it can reinstate service when traffic conditions warrant.

Delta Air Lines, Inc. hereby applies under 49 U.S.C. § 40109 for renewal of exemptions authorizing Delta to continue to provide scheduled foreign air transportation of persons, property, and mail on the U.S.-Mexico routes identified in Exhibit A. This renewal application encompasses multiple docketed exemptions that Delta relies upon to provide nonstop U.S. Mexico services with its own aircraft or pursuant to codeshare arrangements with Aerovias de Mexico, S.A. de C.V. or Delta Connection carriers. Delta requests that these exemptions be renewed for a period of at least two years, with a common expiration date, or until 90 days after the Department's final determination on Delta's application for amended certificate authority as it pertains to each of the routes identified herein, filed on November 30, 2004, and supplemented on October 17, 2005, in Docket OST-1999-6275, whichever occurs earlier. The establishment of a common renewal date will promote administrative efficiency and reduce the burden on Delta and the Department in maintaining these multiple non-controversial U.S.-Mexico exemption authorities.
Delta does not seek renewal of route integration authority included with these exemptions because such authority is now covered by its blanket route integration certificate issued by Order 2006-1-1.
In certain instances, Delta holds two exemptions for a single U.S.-Mexico route: one for codesharing service and one for service with its own aircraft. Although it is Delta's understanding that a single "own aircraft" exemption would be sufficient to cover both types of service (just as a city-pair designation authorizes both own-aircraft service and codeshare service), Delta is seeking to renew potentially redundant exemption authority out of an abundance of caution.

Application for Renewal of Exemption
Aeromexico seeks renewal of its exemption authority to provide service between Mexico City and Chicago. The authority was granted by Notice of Action Taken, dated February 9, 2000, and last renewed by Notice of Action Taken dated June 9, 2006. It currently is set to expire on June 9, 2007. Aeromexico currently is serving the route with daily nonstop service operated with B-737 aircraft, and it desires to renew the authority for an additional year so that it can continue the service, which has provided significant benefits for the traveling public.
The Notice of Action also granted Delta Air Lines, Inc., exemption authority to engage in foreign air transportation in this market pursuant to a code share arrangement with Aeromexico. Aeromexico's authority to carry Delta's code is of indefinite duration.
