United requests a statement of authorization to display Austrian's "OS" designator code on flights operation by United (1) between any point in the United States and any point in Austria (nonstop or via intermediate points); (2) between any points in the United States in conjunction with services held out by Austrian between Austria and the United States; and (3) between any point in the United States or Austria and any point in any third country. Austrian requests a statement of authorization to display United's "UN' designator code on flights operated by Austrian (1) between Austria and the United States (nonstop or via intermediate points); (2) between any points in Austria in conjunction with services held out by United between the United States and Austria; and (3) between any point in Austria or the United States and any point in a third country.

Initially, this service will involve United's displaying Austrian's code on United's flights between Austrian's U.S. gateways of New York, Chicago and Washington and 20 U. S. cities.

Notice of Additional Codeshare Services

United and Austrian hereby notify the Department of additional proposed codeshare services involving the display of United's designator code on flights to be operated by Austrian between Vienna, Austria, and Baghdad, Iraq.

Austrian is not currently serving Iraq. However, there is an urgent and compelling need for air service between the United States and Iraq to assist in post-war reconstruction efforts. Other carriers have already applied for authority, so that needed flights can begin as soon as governmental service restrictions are lifted.

Answer of Northwest Airlines and Motion for Leave to File

Today, Northwest also filed applications with the Department seeking exemption and certificate authority to provide scheduled foreign air transportation of persons, property and mail between any point or points in the United States, via intermediate points, and any point or points in Iraq and beyond. Northwest submits this Consolidated Answer to request that the Department grant Northwest’s applications simultaneously with the applications already filed by World Airways, Inc., North American Airlines, Inc., and United/Austrian for Iraq service. To the extent the U.S.-Iraq market may be a limited-entry market for U.S. carriers, the Department should consider these and any other Iraq service applications contemporaneously in a selection proceeding consistent with the Department’s past practice and Ashbacker Radio Corp. v. FCC, 326 U.S. 327 (1945).

Consolidated Answer of Delta Air Lines

Delta stands ready, willing and able to provide new service to Iraq, which will provide important benefits to support the post-war reconstruction and humanitarian relief efforts now underway in Iraq. Unlike several carriers that have recently sought new certificate and exemption authority, Delta already holds underling authority to serve Baghdad by virtue of its existing certificate on Segment 3 of Route 616. Order 91-10-33.

Delta is evaluating a variety of service options, involving direct, and/or codeshare flights. Delta expects that the U.S. Government will foster and promote a liberalized air service regime with Iraq, so that U. S. and Iraqi travelers can enjoy the import benefits of competitive air service, as Iraq resumes a more prominent role in the global economy. However, to the extent air service opportunities may be limited in the near term, Delta hereby places the Department on notice of Delta's intention to serve Baghdad. Under Ashbacker Radio Corp. v. FCC, 326 U.S. 327 (1945), Delta is entitled to contemporaneous consideration along with the other pending requests for U.S.-Iraq service.

30-Day Notice of Additional Codesharing and Codeshare Integration

In an effort to more fully integrate their code-sharing operations, hereby notify the Department that any 30-day notice provided to the Department for code-share service between United and any Austrian Airlines Group carrier under their blanket code-sharing authority should be deemed notice given for all of the affiliated carriers of the Austrian Airlines Group. This will enable United and the Austrian Airlines Group carriers to provide a single 30-day notice of any additional code-sharing that any of the carriers may undertake under their code-share arrangements. Consolidation of the carriers' code-share notifications will alleviate unnecessary administrative burdens on United, the Austrian Airlines Group, and the Department itself, and permit routine schedule changes as necessary to enable the Austrian Airlines Group carriers to more efficiently allocate fleet resources between the Group's member carriers. Summaries of the existing authorized code-share service points, where either Austrian, Lauda, or Tyrolean may operate by carrying United's designator code and where United may operate by carrying Austrian's or Lauda's designator code, are included as Attachments A and B.

The only new city pair not already noticed is Washington‑Zurich in Attachment B

Hereby notifies the Department that United intends to display the designator codes of these foreign carriers on flights it operates between and among the U.S. cities listed in Exhibit A hereto. In addition, United hereby notifies the Department it intends to display the codes of these foreign carriers on flights it operates between any of the U.S. cities listed in Exhibit A hereto and any of the Canadian cities listed in Exhibit B hereto.

The code-share services will be operated as part of United's mainline operations as well as its United Express code-share arrangements with Air Wisconsin, Mesa Airlines, SkyWest Airlines, and Trans States Airlines. Docket OST-04-17986). This notice will enable United and United Express carriers to operate code-share services interchangeably to the points listed without the need to file repetitive notices as connecting services shift from one carrier to another.

United has not included Air Canada in this notice as it has authority to display Air Canada's designator code on all U.S-Canada transborder flights operated by United and on flights operated by United beyond any U.S. gateway to any U.S. point. See Statement of Authorization #98-54, June 12, 1998 (Undocketed).

(July 19, 2007, Docket OST-2007-28628), Scandinavian Airlines System (May 24, 1999, Docket OST-1999-5251), TACA International Airlines, S.A., and Lineas Aereas Costarricenses S.A. Re: Receipt of 30-Day Notices

We are in receipt of five 30-Day Notices from United each dated January 17, 2008, notifying the Department of the carrier's proposed expanded code-share services involving (1) United and various foreign carriers; (2) United's affiliate, Mesa Airlines, Inc., and various foreign carriers; (3) United's affiliate, GoJet Airlines, LLC, and various foreign carriers; (4) United's affiliate, Shuttle America Corporation, and various foreign carriers; and (5) United's affiliate, Sky West Airlines, Inc., and various foreign carriers.

We have reviewed the services proposed and have no objection to the Notices. In this regard, however, we note that no services that become newly available under the first phase U.S.-EU Air Transport Agreement can be implemented before March 30, 2008.
