OST Docket 46760

Order 98-4-7 | 46760 | 46393 | Issued April 8, 1998 | Served April 13, 1998

By Order 93-1-7, we terminated this proceeding, and also addressed the question of confidential treatment for certain data relating to Mr. Ho's finances. Although we granted confidential treatment to some of these documents, we denied such treatment for certain deposition excerpts, on the grounds that the material had already been made public. Mr. Ho and a business associate, Mr. Yokeno, petitioned for reconsideration of this aspect of our decision. They argue that they do not believe that the portions of Mr. Ho's deposition were ever made public, and that any portion of Mr. Yokeno's deposition that may have appeared in a non-confidential exhibit "has not resulted in any actual disclosure adverse" to Mr. Ho's interests. In view of these points, and given the extended period since any activity in this case, we will extend confidential treatment to the documents for which such treatment was denied in Order 93-1-7 (21 excerpted pages of depositions by Mr. Ho and Mr. Yokeno). We will also take this opportunity to close the dockets in both this proceeding and the related Application of Discovery Airways, Docket 46393.
