Joint Motion to Amend Final Order Granting Approval of And Antitrust Immunity for Alliance Agreements - Bookmarked
By this motion, United Air Lines, Inc. and Air Canada and their respective affiliates request that, in light of the Open Skies air service agreement reached between the United States and Canada on November 10, 2005, the Department amend Order 97-9-21, in which it approved and granted antitrust immunity for alliance agreements between the Joint Movants pursuant to 49 U.S.C. § 41308 and 41309." Specifically, the Joint Movants request that the Department eliminate the condition contained in ordering paragraph 1(a) of that Order, which states that the approval and immunity shall not apply to operations involving all-cargo services or services to or from third countries. The Joint Movants request that the amended grant of immunity be issued as soon as possible, and made effective contemporaneously with the effectiveness of the Open Skies Agreement, which is expected to occur by September 2006.

United requests a Statement of Authorization authority to display Air Canada's "AC" designator code on flights operated by United between San Francisco, CA and Sydney, NSW, Australia. Air Canada requests a Statement of Authorization for authority to display United's "UA" designator code on flights operated by Air Canada between Vancouver, BC, Canada and Sydney, NSW, Australia. The Joint Applicants plan to begin services over these routings on or after May 23, 2008.
United currently holds a Certificate of Public Convenience and Necessity for Route 838 authorizing United to engage in scheduled foreign air transportation of persons, property and mail between points in the U.S. and points in Canada and Australia nonstop and via intermediate and beyond points. Order 2007-4-19. United and Air Canada are parties to a code-share agreement under which services were initially approved by Order 95-10-27. DOT has also subsequently issued statements of authorization to authorize code-share service by United and Air Canada between the U.S. and Canada, on the one hand, and third countries such as Australia, on the other. Air Canada will not be selling fifth-freedom service in the local San Francisco-Sydney market. Air Canada also has applied in Docket OST-2007-28768 for expanded authority to engage in scheduled foreign air transportation of persons, property and mail from points behind Canada via Canada and intermediate points to points in the U.S. and beyond. That application is pending before the Department.
