Consent Order

This consent order concerns certain fare advertisements on United Air Lines' website that failed to disclose adequately one of the significant restrictions applicable to a discount fare program available to US military personnel, referred to as the "United Thanks our Troops" program. These advertisements, consequently, constituted an unfair and deceptive trade practice in violation of 49 USC 41712. Based on these violations, the order directs the carrier to cease and desist from future similar violations.

Application for Renewal of Exemption Authority

United Air Lines, Inc. hereby applies for renewal of an exemption from 49 U.S.C. § 41101 authorizing it to provide scheduled foreign air transportation of persons, property, and mail between Miami, Florida and Bonaire, Netherlands Antilles and to co-terminalize its Bonaire services with services to Curacao, Netherlands Antilles, and Port-au-Prince, Haiti. The exemption authority, as amended, is currently effective through April 27, 2007. Untied requests that this exemption authority be renewed for a minimum period of two years.

On January 11, 2002, United notified the Department that its code-share arrangement with Air ALM was terminated. However, United would like to renew its exemption authority, so that it may utilize this authority to serve Miami-Bonaire with another code-share partner in the future. Renewal of this authority would give United the flexibility to quickly start services with a new code-share partner.

Application of United for Renewal of Exemption Authority

United hereby applies for renewal of an exemption from 49 U.S.C. §41101 authorizing it to provide scheduled combination service in foreign air transportation of persons, property, and mail between Chicago, Illinois and San Jose del Cabo, Mexico. United’s exemption authority is currently effective through July 28, 2007, and this renewal application is being timely filed in compliance with the Department’s rules.

United intends to continue its year-round service between Chicago and San Jose del Cabo. The Department has found United fit to provide foreign scheduled combination air transportation. See, Route 838, Order 2007-4-19, and Route 747, Order 2004-5-23.

Application for Reactivation of Exemption Authority

United Air Lines, Inc. hereby requests the Department to reactivate its dormant U.S.-Mexico exemption authority, which was previously issued to United in the above-referenced proceeding to operate seasonal services between Chicago, IL and Cozumel, Mexico. This authority was last issued in a Notice of Action Taken, dated April 21, 2006, renewing United’s Chicago-Cozumel authority for a period extending to April 21, 2008. See, Docket OST-2004-17490. United gave notice of dormancy in a letter dated December 19, 2006, when it decided not to reinstate seasonal services at that time due to the destruction caused by Hurricane Wilma in 2005.

United has now decided to reinstate weekly, seasonal Chicago-Cozumel non-stop services, operating each Saturday from December 15, 2007 through the following April and a similar seasonal pattern each year thereafter. United will use A320 equipment with 138 seats (12F; 126Y). In these circumstances, United requests that its exemption authority be reactivated effective immediately to enable it to reinstate this service. There continue to be sufficient designations available under the U.S.-Mexico Air Services Agreement to allow the Department to reactivate United’s authority for the Chicago-Cozumel market. In fact, while all three designations in the Chicago-Cozumel market are currently available, only one other carrier (USA3000) has thus far requested the authority (Docket OST-2007-28577) to serve this market.

By Notice of Action Taken, dated July 28, 2005, in Docket OST-2005-22799, the Department awarded United an exemption to operate scheduled combination services in the Chicago and St. Lucia market. United’s exemption authority is currently effective through October 27, 2007. United requests that the Department renew this exemption authority for a minimum period of two years.

United does not presently serve the Chicago and St. Lucia market but would like to renew its exemption authority in order to give United the flexibility to quickly start services in the future.
