On July 3, 2001, the Department granted United a statement of authorization to display bmi's designator code on United's flights between Chicago and Washington (Dulles), on the one hand, and Mexico City, on the other hand, on a blind sector basis.

Consolidated Answer of Delta Air Lines
Delta stands ready, willing and able to provide new service to Iraq, which will provide important benefits to support the post-war reconstruction and humanitarian relief efforts now underway in Iraq. Unlike several carriers that have recently sought new certificate and exemption authority, Delta already holds underling authority to serve Baghdad by virtue of its existing certificate on Segment 3 of Route 616. Order 91-10-33.
Delta is evaluating a variety of service options, involving direct, and/or codeshare flights. Delta expects that the U.S. Government will foster and promote a liberalized air service regime with Iraq, so that U. S. and Iraqi travelers can enjoy the import benefits of competitive air service, as Iraq resumes a more prominent role in the global economy. However, to the extent air service opportunities may be limited in the near term, Delta hereby places the Department on notice of Delta's intention to serve Baghdad. Under Ashbacker Radio Corp. v. FCC, 326 U.S. 327 (1945), Delta is entitled to contemporaneous consideration along with the other pending requests for U.S.-Iraq service.

Application for Renewal of Exemption Authority
By Notice of Action Taken, dated August 6, 2001, in Docket OST-95299, the Department renewed an exemption authorizing United to operate scheduled combination service between Miami, Florida and Bonaire, Netherlands Antilles, pursuant to a code-share arrangement with ALM 1997 Airline N.V., and amended that exemption to authorize United to integrate its Miami-Bonaire service with its authority on Routes 57 and 632 and other existing authority and to co-terminalize its Bonaire services with services to Curacao, Aruba, and Port-au-Prince. The exemption authority, as amended, is currently effective through August 6, 2003. United requests that this exemption authority be renewed for a minimum period of two years.
On January 11, 2002, United notified the Department that its codeshare arrangement with Air ALM was terminated. However, United would like to renew its exemption, so that it may utilize this authority to serve Miami-Bonaire with another code share partner in the future. Renewal of this authority would give United the flexibility to quickly start services with a new code-share partner. This service would increase options for passengers in the U.S,-Caribbean market.
The Department's last renewal notice refers to United's "intention" to offer this service under its arrangement with Air ALM. On September 4, 2003, United plans to offer service between Seattle, WA and Beijing, People's Republic of China via Tokyo, Japan. United's authority to operate this service is derived from its Certificate of Public Convenience and Necessity for Route 130, Segment 10 (Seattle-Tokyo) and its Certificate of Public Convenience and Necessity for Route 246 (Tokyo-Beijing). Both of those certificate authorizations were in effect at the time that the route integration exemption in this proceeding was last renewed. Files the following supplement to clarify its application dated November 17, 2003, in the above-captioned docket: In its captioned application, United requested exemption authority to serve several U.K. islands in the West Indies. Although there were no objections and the services were all consistent with the U.S.-U.K. bilateral air services agreement, there has been no action by the Department on the exemption application. This delay by the Department is understood to be due, at least in part, to a delay in receiving clearance from the Department of Homeland Security.
In order to expedite action on this application, United limits its request for immediate action to its exemption to serve Providenciales, Turks and Caicos. The balance of the application may be deferred to afford the time necessary for additional clearances. United seeks authority to serve Providenciales by code sharing on services currently operated by US Airways to that point. These services, as well as those of other U.S. earners such as Delta and American, are currently operating to and from the airport at Providenciales which has evidently received the necessary TSA clearances. United is not proposing new services to Providenciales but would merely market services under its own designator code on flights currently operated by US Airways to and from that point which have been cleared by all levels of the government.
In order to expedite issuance of the authority needed by United to codeshare on US Airways services to Providenciales, United urges the Department to defer action on its request for exemption authority to serve Anguilla, Montserrat and the British Virgin Islands. United has no immediate plans to serve points on these islands and is prepared to await the normal course of clearances for their authorization. Because there is no U.S. carrier service operated to some of these islands, such as Anguilla and Montserrat, the necessary airport security clearances may be unnecessarily delaying United's authority to start offering code‑share service on US Airways' existing flights to Providenciales. Deferral of those portions of United's application not relevant to the code‑share service to Providenciales will not, in these circumstances, have any adverse affect on implementation of immediate service plans or deprive consumers of any new competitive services.

Answer and Motion to Consolidate of Allegiant Air
Allegiant has today filed an application for exemption authority to engage in scheduled air transportation of persons, property, and mail between Denver, Colorado and Cancun, Mexico. As stated in that application, Allegiant has an established interest in Denver-Cancun service, having operated regular and frequent public charter flights in that market for over 10 months which are expected to continue until supplanted by Allegiant scheduled service. Allegiant has, to date, carried over 40,000 passengers on these flights. Conversion of Allegiant's Denver-Cancun flights to scheduled service will enable the carrier to serve an even broader segment of the public. United's proposal to operate one round trip per week pales in comparison to the four weekly round trips Allegiant would operate. These factors, among others, establish that Allegiant's Denver-Cancun scheduled service would provide far greater public benefits than United's. Accordingly, given that Denver-Cancun is a limited-entry market, Allegiant opposes United's application.
Under the U.S.-Mexico Bilateral Air Services Agreement, the United States may designate up to two U.S. carriers to serve each eligible U.S.-Mexico citypair. At present, Frontier Airlines is designated to provide service between Denver and Cancun, leaving one additional designation available for allocation. Three carriers - Allegiant, Champion Air, and United - have applied for Denver-Cancun exemption authority. Given these circumstances, Allegiant submits that contemporaneous consideration of the three applications will be conducive to the proper dispatch of the Department's business and to the ends of justice, and will not unduly delay the proceedings. Allegiant therefore moves for consolidation of the proceedings in Docket OST-2004-17299, Docket OST-2004-17407, and the Docket in which Allegiant's application has been filed today.

Consolidated Answer and Motion of Champion Air for Consolidation
Champion Air objects to the applications of United and Allegiant for exemption authority in both the Denver‑Cancun city‑pair and the Denver‑Puerto Vallarta city‑pair to the extent that these applications preclude Champion Air's applications for authority in these markets.
Pursuant to the U.S.-Mexico Air Services Agreement, only two U.S. carriers may be designated for scheduled services on each city-pair. Frontier Airlines holds one of the two designations in the Denver-Cancun market (Docket OST-2002-13061) and one of the two designations in the Denver-Puerto Vallarta market (Docket OST-2002-15371). Consequently, the applications of Champion Air, United and Allegiant for authority to serve Denver-Cancun are mutually exclusive, as are the applications of Champion and United to serve Denver-Puerto Vallarta. Champion Air supports United's Motion to consolidate all of the Denver applications into a single carrier selection case for contemporaneous consideration. Champion Air agrees with United that consideration of these Denver-Mexico applications in separate proceedings would result in duplication of efforts and a relative inefficient utilization of both carrier and Departmental resources. However, Champion Air urges the Department to conduct a simplified and expedited proceeding.

Consolidated Answer of Frontier Airlines, Inc.
Frontier Airlines, Inc. hereby submits the following comments in response to the applications of United Airlines, Inc. for authority to operate nonstop service between Denver, Colorado and Cancun, Mexico and for authority to operate nonstop service between DEN and Puerto Vallarta, Mexico and United’s motion to consolidate its application along with its opposition to the applications of Allegiant Air, Inc. and Grand Holdings, Inc. d/b/a Champion Air to serve CUN.
On April 5, United sought an exemption authorizing "it" to provide scheduled foreign air transportation of persons, property and mail between DEN and PVR. In its application, United stated that, "United plans initially to operate daily service using its ‘Ted’ product on a seasonal basis from DEN December through April." Champion also has an application for PVR service.
In order to consolidate multiple cases before the Department of Transportation, a finding must be made that the carrier seeking the consolidation is identical in every respect. For some time, United has treated Ted as a separate brand and entity. While many in the industry and industry observers have noted that United and Ted operate with the same personnel and costs and out of the same facilities, United continues to imply through various means including advertising and its website that Ted is somehow different. For example, a Reuters March 23, 2004 article noted, "United Airlines Tuesday said Ted, its low-fare carrier, is running ahead of internal forecasts and said it will expand to offer flights out of Chicago O’Hare Airport. " Is Ted a carrier or not? Before the Department grants United’s motion to consolidate, United should agree that there is no difference between United and Ted and that no Ted entity exists. It is United that is seeking both Mexico authorities.

Application for Renewal of an Exemption
United intends to continue to operate seasonal nonstop service with its own aircraft between Denver and Mexico City. Renewal of this exemption authority, as requested herein, is clearly in the public interest, and United requests renewal of its exemption based on the original findings that the proposed services are fully consistent with the bilateral air transportation agreement between the U.S. and Mexico. On August 15, 2002, the Department approved United's request to convert its code-share only designation for Denver-Mexico City to a direct service designation so United could commence seasonal nonstop service between Denver and Mexico City with its own aircraft. (See attached copy of Department Action dated August 15, 2002; See also, Department Action on Application in Docket OST-02-13092, dated August 15, 2002.) United's exemption authority to serve Denver-Mexico City is currently set to expire on June 20, 2004.
By this same NOAT, United was granted exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between Sacramento, California and Guadalajara, Mexico, under a code-share arrangement with Mexicana, and Mexicana was granted a statement of authorization to display United's designator code on flights operated by Mexicana between Sacramento and Guadalajara and between Denver and Mexico City. By letter dated November 14, 2003, a copy of which was filed in the above-referenced docket, United and Mexicana notified the Department of the termination of all of their code-share services with each other effective March 31, 2004. As United's exemption authority for Sacramento-Guadalajara is for code-share service only, United is not seeking renewal of its exemption authority to serve that city-pair.

The City is committed to encouraging new air service and competition at O'Hare and Midway. Currently, no non-stop scheduled service exists between Chicago and Cozumel, Mexico. However, on March 19, 2004, ATA Airlines, Inc. applied for an exemption to provide service between Midway and Cozumel. Docket OST-04-17377. The City filed its support of ATA's application in the Docket on April 5, 2004.

For San Francisco-San Jose del Cabo and San Francisco-Puerto Vallarta, United initially proposes to operate daily service using its "Ted" product on a seasonal basis at San Francisco International Airport from December through April starting December 16, 2004. For San Francisco-Cancun United initially proposes to operate Saturday service on a seasonal basis at San Francisco International Airport from December through April starting December 18, 2004. For Los AngelesIxtapa/Zihuatanejo United initially proposes to operate Saturday service on a seasonal basis at Los Angeles International Airport from December through April starting December 18, 2004. From its San Francisco and Los Angeles hubs, United and United Express serve 56 and 50 non-stop destinations, respectively, offering connection opportunities to points throughout its system.
United plans to operate the San Francisco‑San Jose del Cabo and San Francisco‑Puerto Vallarta services with A320 equipment with 156 seats, including 66 Economy Plus and 90 Economy seats, or similar aircraft. United plans to operate the San Francisco‑ Cancun service with B757 equipment with 182 seats, including 24 First Class, 50 Economy Plus and 108 Economy seats, or similar aircraft. United plans to operate the Los Angeles‑Ixtapa/Zihuatanejo service with A320 equipment with 138 seats, including 12 First Class, 36 Economy Plus and 90 Economy seats, or similar aircraft.
Currently, only one U.S. carrier is designated and operating nonstop service on each of these city-pair routes. Application for Designation and Frequency Allocation
Requests (1) designation as a U.S. flag combination carrier to operate services between the U.S. and Vietnam pursuant to the U.S.-Vietnam bilateral air services agreement of 2003 and (2) allocation of seven weekly combination frequencies for fifth-freedom services between Ho Chi Minh City, Vietnam, and Hong Kong under the U.S.-Hong Kong bilateral air services agreement of 1997, as amended. United requests these authorizations in order to start scheduled combination services between San Francisco and Ho Chi Minh City, Vietnam, via Hong Kong. United requests that its designation be effective immediately for an indefinite period and its frequency allocation be effective December 10, 2004 and remain in effect for an indefinite period subject to the usual conditions.
United plans to operate services between its hub at San Francisco, CA and Ho Chi Minh City, Vietnam, via Hong Kong. United will begin these services by extending an existing San Francisco-Hong Kong nonstop flight to Ho Chi Minh City. These Hong Kong-Ho Chi Minh City services will also connect to United's daily Chicago-Hong Kong nonstop flights, offering convenient onestop online services between Vietnam and United's largest hub. These services will be operated in B747-400 equipment configured in 347 seats (14 F, 73 C, 260 Y). Those aircraft are currently available and are used for United's existing San Francisco-Hong Kong nonstop services. United will operate these services on a daily basis and will sell its services to local passengers between Hong Kong and Ho Chi Minh City. Such fifth-freedom sales are essential to the economic viability of these services and, as noted above, are consistent with the provisions of the U.S. agreements with both Hong Kong and Vietnam.

As indicated in the CAAV's letter of March 16, 2004, they have agreed to allow such fifth-freedom rights to be exercised as early as June 2004, and United's proposed December 10, 2004, startup date for San Francisco-Hong Kong-Ho Chi Minh City services is consistent with CAAV's decision.
