The Department generally grants confidential treatment to contractual agreements and markets an applicant proposes to serve, and we see no reason not to do so here. While the Department generally does not grant confidential treatment to an applicant’s financing plans or first- year operating forecast, we find that the grant of confidential treatment is warranted in this case in light of Pinnacle’s service agreement with Delta. In regards to Pinnacle’s September 19 motion to withhold information from public disclosures, we have decided to grant confidential treatment to the Delta Connection Agreement between Delta and Pinnacle. We find this information is similar to material we have granted confidential treatment to in the past and see no reason no to do so here. However, the remaining material requested confidential treatment, specifically the pre-operating expense forecast, forecast financial statements, is denied. In doing so, we find that the applicant has not shown that substantial harm to its competitive position would result from public disclosure of the given information and such information is not the type that is normally released to the public. Under Rule 12, a Department ruling on motions for confidential treatment will not take effect if, within five business days after issuance, the person requesting confidential treatment files a petition for reconsideration of that decision, or files a statement that he or she in good faith intends to seek judicial review of the decision. If Pinnacle elects to petition the Department as to this confidentiality determination, we expect that it will provide a statement explaining how the item falls within the exceptions under the Freedom of Information Act and is not otherwise required to be filed publicly by all applicants for certificate authority. Responses shall be due within five calendar days of the filing of such a petition. If Pinnacle elects not to file a petition, we direct that the information identified above for which confidential treatment was denied be submitted in the public docket in this proceeding within five business days of the date of this letter. By: Pinnacle, Chris Harrison, 9010-348-4100 Order 2007-10-27 Issued and Served October 24, 2007 Order Issuing Interstate Certificate Authority Pinnacle now seeks certificate authority to operate 16 76-seat CRJ-900 aircraft on behalf of Delta Airlines, Inc. pursuant to an Airline Services Agreement. The air carrier intends to commence operations under the agreement with Delta on or around December 1, 2007. Operations under the Delta code-share agreement will initiate from bases at Salt Lake City and/or Los Angeles International Airport. Ultimately, Pinnacle will operate 16 operational patterns under the Delta agreement. The Department has carefully reviewed Pinnacle’s fitness to undertake the large (76 seat) aircraft operations at issue. No special issues regarding the applicant have come to our attention and no objections to the application have been filed. Moreover, we note that Pinnacle’s commuter operations, using aircraft with up to 50 seats, have been conducted satisfactorily under its current ownership and management. In light of these circumstances, we have decided that neither an oral evidentiary hearing nor a show cause proceeding is necessary for us to make a decision in this case. We find that Pinnacle Airlines, Inc. d/b/a Northwest Airlink d/b/a Delta Connection, is fit, willing, and able to engage in interstate and foreign scheduled air transportation of persons, property, and mail. We issue a certificate of public convenience and necessity to Pinnacle Airlines, Inc. d/b/a Northwest Airlink d/b/a Delta Connection to engage in interstate air transportation. OST-2008-0005 - Exemption - Atlanta-Cozumel January 7, 2008 Pinnacle Airlines Inc. d/b/a Delta Connection applies for an exemption from 49 U.S.C. § 41101 to authorize Pinnacle to engage in scheduled foreign air transportation of persons, property and mail between Atlanta, Georgia and Cozumel, Mexico. Pinnacle requests that this authority remain in effect for a period of two years or for such longer period as the Department sees fit to grant. Pinnacle plans to operate Atlanta-Cozumel scheduled service with 76-seat CRJ-900 aircraft from its existing fleet. The route is currently served by Delta Connection carrier Atlantic Southeast Airlines. Pinnacle will assume the schedule operated by ASA pursuant to a capacity purchase agreement with Delta Air Lines, Inc. OST-2008-0005 - Exemption - Atlanta-Cozumel Filed January 7, 2008 | Issued February 13, 2008 Scheduled foreign air transportation of persons, property, and mail between Atlanta, Georgia, and Cozumel, Mexico. Pinnacle states that it is authorized to represent that it will replace the Delta Connection CRJ-700 aircraft service currently operated by Atlantic Southeast Airlines in the Atlanta-Cozumel market, with Pinnacle’s larger CRJ-900 aircraft, and will provide the service under Delta’s “DL*” designator code as a Delta Connection carrier, beginning no later than July 1, 2008. Pinnacle further states that it will provide year-round service in the market, except for certain peak periods when its service will be replaced with Delta’s mainline service. By: Paul Gretch
OST-2007-0084 - Blanket Route Integration Authority and Blanket Open-Skies Certificate Authority February 25, 2008 Application for a Certificate of Public Convenience and Necessity Pinnacle Airlines, Inc. applies for a certificate of public convenience and necessity to engage in scheduled foreign air transportation of persons, property and mail between (i) a point or points in the United States and a point or points in all countries with existing "Open Skies" Air Services Agreements with the United States, via intermediate points and beyond; and (ii) a point or points in the United States and a point or points in all countries that in the future become U.S. open-skies partners, via intermediate points and beyond. Pinnacle requests that all authority issued in response to this application be effective for an indefinite period. Pinnacle operates primarily scheduled service between various points in the United States as well as between points in the United States and points in Canada and Mexico, all pursuant to capacity purchase agreements with various code-share partners. Pinnacle anticipates that in the future as more open-skies agreements are reached with countries in the Caribbean and Central America, its code-share partners will request expansion of the points Pinnacle serves pursuant to these capacity purchase agreements to include additional foreign markets. The open-skies authority requested here is ideally suited to that purpose since it will maximize flexibility enabling flights to operate from less prominent foreign points of origin. Issuance of such authority would eliminate the need for multiple applications for non-controversial exemption or certificate authority, conserving the Department's and Pinnacle's time and resources. Pinnacle explains that it will assume the scheduled service currently operated by the Delta Connection carrier, Atlantic Southeast Airlines, pursuant to a capacity purchase agreement with Delta Air Lines, Inc., whereby Pinnacle will operate the subject service under Delta’s “DL*” code, supplementing Delta’s mainline service on the route. OST-2007-28867 - Certificate of Public Convenience and Necessity - US-Canada April 4, 2008 Re: Corrected Application - 529 Pages This letter is to confirm our recent communication concerning the above referenced docket. As an initial matter, it recently came to my attention that the application for a Certificate of Public Convenience and Necessity filed by Pinnacle Airlines, Inc. on July 26,2007 (OST-2007-28867-0001) contains a resume bearing Pinnacle's Chief Pilot's Social Security Number on page 41. Pinnacle would like to remove this Social Security Number from public view. As we discussed, enclosed is a flash drive that contains Pinnacle's entire application (all 526 pages of it) with the Social Security Number on page 41 redacted. This document has not been modified in any other way from the original submitted last year. Pinnacle proposes that the document on the enclosed flash drive replace the document found at OST-2007-28867-0001 on the Federal Docket Management System.
