Pan American World Airways Dominicana, C. Por A. d/b/a PAWA Dominicana OST-2007-29368 - Foreign Air Carrier Permit - Dominican Republic-US Scheduled Passenger September 27, 2007 Application for a Foreign Air Carrier Permit - Bookmarked In its initial operations, PAWA Dominicana plans to operate regularly scheduled foreign air transportation carrying persons and cargo between Santo Domingo and Santiago, in the Dominican Republic, and San Juan and Aguadilla, in Puerto Rico, and also plans to operate on-demand charter air transportation carrying persons and/or cargo between points in the Dominican Republic and points in Puerto Rico. As noted above, PAWA Dominicana plans to begin operations serving Puerto Rico on or about November 22, 2007. PAWA Dominicana plans to operate the foregoing services utilizing British Aerospace Jetstream 3100 turboprop aircraft configured to carry 17 passengers and/or up to 4,861 pounds of cargo. Counsel: Zuckert Scoutt, Nathaniel Breed OST-1998-3304 - Family Assistance Plans October 29, 2007 Counsel: Zuckert Scoutt, Nathaniel Breed, 202-973-7939, npbreed@zsrlaw.com OST-2007-29368 - Foreign Air Carrier Permit - Dominican Republic-US October 31, 2007 PAWA Dominicana hereby submits this Amendment No. 1 to the captioned Application, pursuant to Rule 302.5 of the Procedural Regulations of the U.S. Department of Transportation in which PAWA Dominicana requests the issuance of a Foreign Air Carrier Permit authorizing PAWA Dominicana, a Dominican Republic air carrier, to provide scheduled and charter foreign air transportation carrying persons, property and mail between Santo Domingo and Santiago, and other points in the Dominican Republic, on the one hand, and San Juan and Aguadilla, Puerto Rico, and other points in the United States, on the other hand. PAWA Dominicana specifically requests that it be granted an exemption authorizing it: (1) to provide scheduled air transportation between Santo Domingo and Santiago, Dominican Republic, on the one hand, and San Juan and Aguadilla, Puerto Rico, on the other hand, and (2) to provide charter air transportation between any point or points in the Dominican Republic, on the one hand, and any point or points in Puerto Rico, on the other hand, utilizing 19-passenger Jetstream 3100 turboprop aircraft., commencing on or about November 10, 2007. PAWA Dominicana further requests that the foregoing exemption authority requested herein shall remain effective until 90 days after the Department issues an effective Foreign Air Carrier Permit to PAWA Dominicana granting the authority requested in PAWA Dominicana's September 27, 2007 application in this proceeding. To the extent not acted upon above, we dismiss all requests for relief in Docket DOT-OST-2007-29368. With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department . OST-2007-29368 - Foreign Air Carrier Permit - Dominican Republic-US Scheduled Passenger March 12, 2008 Answer of Captain Dirck Hecking in Opposition Mr. Fink has appeared in the Dominican Republic, as an owner of PAN AMERICAN WORLD AIRWAYS DOMINICANA, C.A., D/B/A PAWA DOMINICANA (a start-up Dominican airline) in pleadings for a Foreign Air Carrier Permit. This is the same Mr. David Fink, revokee and budding felon, plying, in the form of another closely held corporation, outside the 12 mile limit, which appears to be very similar in make-up to the reviled Mellon Group entity BMAC. I submit the US Department of Transportation and Dominican Aviation authorities should take notice. Left alone the new adventure and bright expectations of Mr. Hernandez 63%, a US citizen and his team at PAWA would probably be a good thing. However, since it is a fact that the notorious, revokee, Mr. Fink is a 26 % PAWA owner, who was properly removed from the stateside air carrier business, I believe the department requirement for compliance at PAWA appears challenged if not already fractured. I plea the department to scrutinize closely any apparent effort by any carrier to use the Department's processes, who gives safe harbor to a DOT revokee, to escape and evade his obligations under law. I submit, such is the case here and therefore, PAWA Dominicana, has not demonstrated the necessary management and ownership fitness to operate to or from the United States to the department.
