OST-1998-3844 - Exemption - Minneapolis, Minnesota- Punta Cana January 17, 2006 Application for Renewal of an Exemption Northwest hereby requests renewal of its exemption from 49 U.S.C. § 41101 authorizing Northwest to provide scheduled foreign air transportation of persons, property and mail between Minneapolis/St. Paul, Minnesota and Punta Cana, Dominican Republic, and to integrate such authority with Northwest’s existing certificate and exemption authority to the extent bilaterally permitted. Northwest requests that its renewed exemption be effective for a two-year period. Northwest historically has operated Minneapolis/St. Paul-Punta Cana scheduled combination service once a week during the winter season using A320 aircraft. Northwest does not intend to operate Minneapolis/St. Paul-Punta Cana seasonal service this winter, but seeks renewal of this exemption to enable Northwest to operate the route in the future. Counsel: Northwest, Megan Rosia, 202-842-3193 OST-2003-15191 - Exemption - US-Points Worldwide on a Third-Country Codeshare Basis Filed January 17, 2006 | Issued February 6, 2006 Amended exemption for two years under 49 U.S.C. 40109 to the extent necessary to permit Northwest to display its designator code on flights operated by its foreign code-share partners on the following services: Scheduled foreign air transportation of persons, property, and mail between points in the United States and points worldwide on a third-country code-share basis pursuant to blanket code-sharing statements of authorization approved by the Department, and to integrate this authority with its existing certificate and exemption authority. KLM, KLM Cityhopper, Société Air France, Alitalia-Linee Aeree Italiane-S.p.A., and CSA Czech Airlines. Although Northwest currently holds exemption authority to code share with KLM and KLM Cityhopper, Northwest asks the Department to specifically name the carriers in this award of exemption authority to simplify foreign government applications. The exemption authority granted here is for operations with the foreign code-share partners named above. Should Northwest and any new code-share partner be granted statements of authorization, Northwest will need to apply for exemption authority to the extent necessary to permit Northwest to display its code on flights operated by the new code-share partners. OST-1999-6319 - Certificate of Public Convenience and Necessity - US-Mexico February 15, 2006 Application for an Amendment of Certificate Authority Northwest requests that the Department amend its Route 564 U.S.-Mexico certificate authority by adding the city pair markets identified above. Northwest’s current certificate for U.S.-Mexico service was last issued on February 26, 2001. See Order 2001-4-15. Northwest filed an application to renew its certificate authority in this docket on November 30, 2004. Northwest seeks to offer scheduled foreign air transportation of persons, property and mail in the above-identified city pair markets pursuant to its codeshare arrangements with Delta and Continental. Northwest's service benefits nonstop passengers traveling between the Twin Cities and Mazatlan, as well as connecting passengers traveling to and from Mazatlan and the scores of cities across the northern tier that are conveniently served through Northwest's MSP hub. For all of the reasons stated in the petitions, the relief sought by Delta and Northwest should be granted and applied on an equal basis to all similarly-situated carriers. United would, however, take this occasion to clarify one matter. Delta's request for relief from dormancy conditions in the context of carrier selection cases raises issues different from those in the case of an uncontested route award. For example, in the case of the pending Los Angeles-Puerto Vallarta Combination Service Proceeding, Docket OST-2005-23497. the start-up dates proposed by both applicants (United and Delta) have passed. The Department in Order 2006-6-25 instead notes that both carriers have said that they would start within 90 days of an award once their proposed dates had passed. United understands this to mean that there will be a start-up condition that would require it to start within 90 days of the service date of a final order awarding the route to United, as has been the Department standard in contested Mexico route cases. The dormancy condition would apply only to services that were started within that 90-day period. Delta, on the other hand, seems to be seeking some additional but undefined "reasonable leeway" in meeting the start-up date. It appears that Delta may be suggesting that it wants a dormancy condition to allow it to start within 90 days of the required start-up date. If that is Delta's position, then this offers the Department yet another reason for reversing its tentative award of Los Angeles-Puerto Vallarta authority to Delta and selecting United instead in circumstances where United will accept a commitment to start its service between Los Angela and Puerto Vallarta within 90 days of the service date of a final order. United, unlike Delta, seeks no additional "leeway" in the form of a more flexible start-up/dormancy condition.
