Application for Renewal of Exemption

The applicant now owns four Convair 580 aircraft registered under the Canadian registration marks C-FTAP, C-GQHB, and C-GRLQ and C-FAWV (Cargo). The applicant is a Private charter operation according to Part 129 of FAR. All the flights between Canada and the United States will be done upon demand, i.e. one way or return charter that will originate in Canada on which the charterer will charter the entire passenger seating capacity and will not resale the passenger seating capacity. The cost of the charter will be borne entirely by the charterer and not directly or indirectly by individual passenger.

OST-2000-8082 - Exemption - US-Canada Cargo Charter

Application for Amended Exemption Authority

Nolinor hereby requests an amendment of its exemption authority from 49 U.S.C. § 41301 to conduct charter foreign air transportation of persons, property and mail between a point or points in Canada and a point or points in the United States. Nolinor requests that this exemption authority be granted for a period of two years.

Nolinor currently holds an exemption from the Department to conduct all-cargo charter operations between Canada and the United States, and other all-cargo charters in accordance with 14 C.F.R. Part 212. Such exemption is set to expire on November 9, 2009. See Notice of Action Taken in Docket OST-2000-8082 issued on November 9, 2007.

Initially, this exemption authority included charter passenger operations. See Notice of Action Taken in Docket OST-2000-8082 issued on October 30, 2000. However, Nolinor ceased conducting charter passenger service on or about October 15, 2004 because its Convair 580 bearing Canadian registration mark C-FTAP did not comply with FAR 129.28 "Flight Deck Security." Nolinor has since acquired a new aircraft, a Boeing 737-200 configured to carry 100 passengers, which is compliant with FAR 129.28 "Flight Deck Security." Thus, Nolinor hereby requests an amendment of its current exemption authority to reinstate charter passenger service.

Nolinor seeks this amended exemption authority in order to re-commence passenger charter service on or about June 30, 2008 between a point or points in Canada and a point or points in the United States. The frequency of flights will vary depending upon demand. The cost of the charter will be borne entirely by the charterer and not directly or indirectly by an individual passenger. The proposed service will be offered on a non-stop basis with a Boeing 737-200 aircraft bearing Canadian registration mark C-GTUK configured to carry 100 passengers.

The applicant requests that its amended exemption authority be granted for a two-year period.

At the request of the applicant, the Department previously deferred action with respect to the renewal of the applicant’s passenger charter authority. See Notice of Action Taken dated October 27, 2004, in this Docket.
