October 6, 2004 SIASA seeks authority to transport persons, and their accompanying baggage, property and mail in charter foreign air transportation between a point or points in Mexico and a point or points in the United States, and in other charter trips in foreign air transportation, without the need for prior Department approval for each series of flights. SIASA also seeks Fifth Freedom authority contingent upon prior Department approval of each Fifth Freedom flight or series of flights. SIASA is also requesting stopover privileges. SIASA will utilize a fleet of small corporate aircraft for service between the United States and Mexico. SIASA's aircraft are fully compliant with Stage 3 noise limitations. October 6, 2004 Motion for Confidential Treatment Counsel: Garofalo Goerlich, John Copley and Victor Smith OST-04-19340 - Exemption - US-Mexico Air Transportation October 28, 2004 Supplement No. 1 to Application for an Exemption Servicios Integrales De Aviacion, S.A. de C.V. d/b/a FlyMex, hereby supplements its application of October 6, 2004 for an exemption from 49 U.S.C. § 41301 to permit SIASA to engage in charter foreign air transportation of persons and their accompanying baggage, property and mail between a point or points in Mexico and a point or points in the United States and in other charter trips in foreign air transportation, subject to the terms, conditions and limitations of the Department's regulations governing charters. SIASA also requested stopover privileges and relief from the requirement to obtain advance approval for each series of flights between Mexico and the U.S. SIASA requested a one-year term of authority. SIASA hereby modifies its initial exemption application to withdraw any reference to SIASA's current cargo authority and any request for charter cargo authority from the Department. SIASA retains its request to carry passengers, as well as their accompanying baggage, property and mail on its passenger charters. SIASA also requests stopover privileges and relief from the requirement to obtain advance approval for each series of flights between Mexico and the U.S. We found that the applicant is operationally and financially qualified to conduct its proposed operations and is substantially owned and effectively controlled by citizens of its homeland. Also, the FAA advised us that it knows of no reason to withhold this authority. In the conduct of these operations, the carrier must adhere to all applicable provisions of the Agreement. In the conduct of these operations, the carrier may use only aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds (small equipment). The above grant includes authority to conduct Third and Fourth Freedom charter operations. While we have subjected, consistent with the provisions of the Agreement, Mexican carriers conducting charter operations with large aircraft to prior approval or submission of notice for their Third or Fourth Freedom charters, we determine that any such requirement is not necessary on public interest grounds, in this case, since the carrier will be conducting these operations solely with small aircraft. (Other charter operations to/from the United States under this authority, however, are subject to prior approval under 14 C.F.R. Part 212.) Further, we are continuing to allow Mexican carriers conducting passenger charters using small equipment to make stopovers in the United States in the conduct of such operations. The exemption also authorizes, and SIASA hereby applies for renewal of, stopover privileges and relief from the requirement to obtain advance approval for each series of flights between Mexico and the US. The authority for which renewal is requested was initially granted on May 13, 2005. SIASA requests that its authority, which now is scheduled to terminate on May 13, 2006, be renewed for an additional one-year period. The applicants also request stopover privileges and relief from the Department’s requirement to provide prior notice of each flight, or series of flights, between Mexico and the United States. Aero Rey, S.A. de C.V., Guja, S.A. de C.V., and Transporte Ejecutivo Aereo, S.A. de C.V. each requested that their authority be granted for a two-year term. As to the other applicants, we have decided, on our own initiative and in the interest of administrative efficiency, to grant the exemption authority for a two-year term. By: Paul Gretch

Part 212, using small equipment. FlyMex also requests renewal of the stopover privileges and relief from the Department's requirement to provide prior notice of each flight, or series of flights, between Mexico and the United States by its Exemption awarded to it. By a Notice of Action Taken dated June 27,2007, FlyMex was granted renewal of its passenger charter exemption authority for a period of one year, and will, therefore, expire by its own terms on June 27, 2008.
