OST-03-16101 - Exemption - Dallas/Ft. Worth-Monterrey, Mexico

September 4, 2003

Application for an Exemption

American Eagle proposes to begin daily Dallas/Ft. Worth-Monterrey nonstop service on January 6, 2004, using either 44-seat ERJ-140 or 50-seat ERJ-145 aircraft. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70-seat CRJ-70 aircraft on this route in the future.

Under the U.S.-Mexico Air Transport Agreement, two U.S. carriers may serve the Dallas/Ft. Worth-Monterrey route. American Airlines is presently the only carrier operating nonstop service in this market. American plans to continue to operate its service, in addition to the service to be provided by American Eagle. American Eagle requests expedited approval of this application so that we may complete arrangements for initiating Dallas/Ft. Worth-Monterrey operations, effective January 6, 2004, and engage in marketing and sales activities at the earliest possible date.

0n April 14, 2002, Atlantic Southeast Airlines, Inc. received a designation to serve Dallas/Ft. Worth-Monterrey using small aircraft under 14 CFR Part 298. ASA does not operate service, and its designation should be revoked.

OST-03-16349 - Exemption - DCA Slot Slides

November 4, 2003

Motion for Leave to File and Answer of Midwest Airlines

What American and Eagle avoid discussing in their application is that together American and its affiliate, that are both wholly owned by AMP, Corporation, currently hold a total of 120 DCA slots. This is a far greater number of slots either held or operated by AlA, Chautauqua, Colgan, or Spirit that were the most recent recipients of authority under §41714(d). See Order 2003-9-30. Nor has the DOT used its §41714(d) authority in the past to grant slot slide authority to carriers that had any substantial DCA slot holdings.

OST-03-16349 - Exemption from 14 CFR Pursuant to 49 USC 41714(d) - DCA Slot Slides

November 13, 2003

Reply of American Airlines and American Eagle Airlines

In our application, we detailed the public benefits that would result from adjusting our schedules in the DCA-Miami and DCA-Raleigh/Durham markets. Those benefits meet the "exceptional circumstances" standard of 49 USC 41714 in equal if not greater measure than the benefits claimed by Colgan and Chautauqua in their applications, which the Department granted by Order 2003-9-30. Our request clearly satisfies the statute and should be promptly approved, notwithstanding Midwest's late-filed objection.

No other applicant has come forward with a competing proposal for any DCA slot slides, much less for the specific hours we are now seeking. Delta and its affiliates plainly had notice of our application, and could have filed their own request if they so wished. The bare possibility of a competing application in the future is insufficient to invoke the Asithacker doctrine. See, e.g. Frontier Airlines Route Realignment Order 75-7-5, July 1, 1975, p. 6 ("it is axiomatic that the mere assertion by a carrier that it intends to seek some form of authority some time in the future does not give that carrier any rights under Ashbacker")

OST-04-17128 - Exemption - Dallas/Ft. Worth-Guadalajara

February 17, 2004

Application for an Exemption

American Eagle proposes to begin daily Dallas/Ft. Worth‑Guadalajara nonstop service on June 10, 2004, using either 44‑seat ERJ‑l40 or 50‑seat ERJ‑145 aircraft. Southbound, American Eagle will depart DFW at 1150 and arrive in GDL at 1419. Northbound, American Eagle will depart GDL at 1510 and arrive in DFW at 1746. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70‑seat CRJ‑90 aircraft on this route in the future.

Under the U.S.-Mexico Air Transport Agreement, two U.S. carriers may serve the Dallas/Ft. Worth-Guadalajara route. American Airlines is presently the only carrier operating nonstop service in this market. American plans to continue to operate its service, in addition to the service to be provided by American Eagle.

On August 25, 2000, Comair received a designation to serve Dallas/Ft.Worth-Guadalajara using small aircraft under 14 CFR Part 298. Comair does not operate service, and its designation should be revoked.

OST-04-17128 - Exemption - Dallas/Ft. Worth-Guadalajara

Filed February 17, 2004 | Issued March 10, 2004

Notice of Action Taken | Word

Exemption for two years under 49 U.S.C. §40109 to provide the following service: Scheduled foreign air transportation of persons, property, and mail between Dallas/Ft. Worth, Texas, and Guadalajara, Mexico.

Under the U.S.-Mexico aviation agreement, up to two U.S. carriers may be designated to serve a given city-pair market. Currently, both Comair and American Airlines, Inc. hold a designation to serve the Dallas/Ft. Worth-Guadalajara market. American is using its authority, but Comair's authority has become dormant. Under the circumstances presented, including our desire to make maximum use of our bilateral rights and in light of the fact that no party opposed American Eagle's application here, we will withdraw the designation of Comair and designate American Eagle in its place.

OST-04-17469 - Exemption - Dallas/Ft. Worth-Torreon

April 1, 2004

Application for an Exemption

American Eagle proposes to begin daily Dallas/Ft. Worth-Torreon nonstop service on August 1, 2004, using either 44-seat ERJ-140 or 50-seat ERJ-145 aircraft.

Worth-Torreon route. No U.S. carrier presently operates nonstop service in this market. Accordingly, American Eagle's request is fully consistent with the bilateral agreement.

Southbound, American Eagle will depart Dallas/Ft. Worth at 1800 and arrive in Torreon at 2007. Northbound, American Eagle will depart Torreon at 0730 and arrive in Dallas/Ft. Worth at 0921.

American Eagle requests expedited approval of this application so that we may complete arrangements for initiating Dallas/Ft. Worth-Torreon operations, effective August 1, 2004, and engage in marketing and sales activities at the earliest possible date.

OST-03-16349 - Exemption - DCA Slot Slides

Issued and Served May 4, 2004

Order | Word

We have decided to deny American’s request.  In making this decision, we have carefully reviewed the application, responsive pleadings, the language of the applicable law, and expressed legislative intent.  Nothing we have found in our review indicates that American, as an incumbent with numerous DCA slots, satisfies the very high bar required to show exceptional circumstances.  We conclude that the circumstances surrounding American’s application are not exceptional.  Rather, they are typical of the circumstances attendant to an incumbent slot holder operating within a slot-controlled, high-density regime at DCA.

Prior orders show the same treatment of § 41714(d).  The Department has granted slide requests to new entrants or limited slot holders that demonstrated specific needs to slide slots to ensure their utility, with relevant factors being whether they facilitate connecting operations (Order 94-9-49 (Sept. 30, 1994)), improve service and strengthen competition (Order 99-11-4 (Nov. 4, 1999) and Order 2000-2-26, affirming Order 99-11-4 (Feb. 22, 2000)), and meet increasing demand in a market (Order 2000-7-20 (July 14, 2000)), or inaugurate service in new markets (Order 2000-2-33 (Feb. 29, 2000)). See also Order 2000-10-27 (Oct. 26, 2000); Order 2000-10-32 (Oct. 27, 2000); Order 2001-3-17 (Mar. 15, 2001); Order 2001-3-30 (Mar. 29, 2001); Order 2002-9-16 (Sept. 16, 2002).

June 8, 2004

Application for an Exemption

Hereby applies for an exemption authorizing scheduled foreign air transportation of persons, property, and mail between Dallas/Ft. Worth, Texas, and Chihuahua, Mexico. American Eagle proposes to begin daily Dallas/Ft. Worth-Chihuahua nonstop service on October 1, 2004, using either 44-seat ERJ-l40 or 50-seat ERJ-145 aircraft. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70-seat CRJ-70 aircraft on this route in the future.

No U.S. carrier presently operates nonstop service in this market. Accordingly, American Eagle's request is fully consistent with the bilateral agreement.

OST-04-18042 - Dallas/Ft. Worth-Chihuahua

December 6, 2004

Motion for Temporary Waiver Dormancy Condition

The subject authority was granted by Notice of Action Taken in this docket on June 25, 2004, subject to a 90-day start-up condition to begin on October 1, 2004, the date that American Eagle initially proposed to start service. Absent a dormancy waiver, the authority would automatically expire on December 30, 2004.

American Eagle now plans to inaugurate Dallas/Ft. Worth-Chihuahua operations on May 4, 2005. Granting a temporary dormancy waiver is in the public interest, as American Eagle has firm plans for starting service. Under the U.S.-Mexico Air Transport Agreement, as amended, two U.S. carriers may be designated between Dallas/Ft. Worth and Chihuahua. No other U.S. carrier is operating nonstop service in this city-pair, and the temporary waiver American Eagle is seeking will facilitate entry.

American Eagle proposes to begin daily Dallas/Ft. Worth-Veracruz nonstop service on July 2, 2005, using either 44-seat ERJ-l40 or 50-seat ERJ-145 aircraft.

Southbound, American Eagle will depart Dallas/Ft. Worth at 1818 and arrive in Veracruz at 2100. Northbound, American Eagle will depart Veracruz at 0742 and arrive in Dallas/Ft. Worth at 1020.

July 14, 2005

Application for Renewal of Exemption

American Eagle currently operates two daily nonstop roundtrips between Dallas/Ft. Worth and Monterrey using 50-seat ERJ-145 aircraft. Renewal is fully consistent with the U.S.Mexico Air Transport Agreement, as amended, and with the public interest. American Eagle requests renewal for an indefinite term, consistent with the petition of American Airlines for a policy statement under 14 CFR Part 399 submitted in OST-1998-3375 on January 23, 1998.

OST-2005-20478 - Exemption - Dallas/Ft. Worth-Veracruz, Mexico

August 16, 2005

Motion for a Dormancy Waiver

Hereby moves for a waiver of the 90-day dormancy condition in Notice of Action Taken in this docket, issued on March 21, 2005. Under that condition, American Eagle's Dallas/Ft. Worth-Veracruz is set to expire automatically on October 1, 2005, which is 90 days following American Eagle's proposed start-up date of July 1, 2005. By this motion, American Eagle requests a start-up deadline of October 1, 2006.

American Eagle has canceled its plans to start Dallas/Ft. Worth-Veracruz service. However, to retain the flexibility to start service when conditions warrant, American Eagle is seeking the relief requested. Under the U.S.-Mexico Air Transport Agreement, as amended, two U.S. carriers may be designated to serve this route. Because American Eagle is the only U.S. carrier so designated, another opportunity will remain available.

By Notice of Action Taken dated March 21, 2005, the Department granted American Eagle’s application, in Docket OST-2005-20478, for exemption authority to conduct Dallas/Ft.Worth-Veracruz combination service on a year-round basis.  American Eagle had advised us that it would commence services on the route on July 2, 2005.  Consistent with our policy for U.S.-Mexico route awards, the authority was subject to the condition that the dormancy notice period would begin on July 2, 2005.  Under those terms, American Eagle must begin Dallas/Ft.Worth-Veracruz services no later than October 1, 2005 (90 days from the date the dormancy notice period begins -- July 2).
