American Eagle proposes to begin daily Dallas/Ft. Worth-Monterrey nonstop service on January 6, 2004, using either 44-seat ERJ-140 or 50-seat ERJ-145 aircraft. American Eagle is seeking exemption authority, rather than a designation for service with small aircraft (60 seats or fewer) under 14 CFR Part 298, in order to obtain the flexibility to use 70-seat CRJ-70 aircraft on this route in the future.
Under the U.S.-Mexico Air Transport Agreement, two U.S. carriers may serve the Dallas/Ft. Worth-Monterrey route. American Airlines is presently the only carrier operating nonstop service in this market. American plans to continue to operate its service, in addition to the service to be provided by American Eagle. American Eagle requests expedited approval of this application so that we may complete arrangements for initiating Dallas/Ft. Worth-Monterrey operations, effective January 6, 2004, and engage in marketing and sales activities at the earliest possible date.
0n April 14, 2002, Atlantic Southeast Airlines, Inc. received a designation to serve Dallas/Ft. Worth-Monterrey using small aircraft under 14 CFR Part 298. ASA does not operate service, and its designation should be revoked.

What American and Eagle avoid discussing in their application is that together American and its affiliate, that are both wholly owned by AMP, Corporation, currently hold a total of 120 DCA slots. This is a far greater number of slots either held or operated by AlA, Chautauqua, Colgan, or Spirit that were the most recent recipients of authority under §41714(d). See Order 2003-9-30. Nor has the DOT used its §41714(d) authority in the past to grant slot slide authority to carriers that had any substantial DCA slot holdings.

In our application, we detailed the public benefits that would result from adjusting our schedules in the DCA-Miami and DCA-Raleigh/Durham markets. Those benefits meet the "exceptional circumstances" standard of 49 USC 41714 in equal if not greater measure than the benefits claimed by Colgan and Chautauqua in their applications, which the Department granted by Order 2003-9-30. Our request clearly satisfies the statute and should be promptly approved, notwithstanding Midwest's late-filed objection.
No other applicant has come forward with a competing proposal for any DCA slot slides, much less for the specific hours we are now seeking. Delta and its affiliates plainly had notice of our application, and could have filed their own request if they so wished. The bare possibility of a competing application in the future is insufficient to invoke the Asithacker doctrine. See, e.g. Frontier Airlines Route Realignment Order 75-7-5, July 1, 1975, p. 6 ("it is axiomatic that the mere assertion by a carrier that it intends to seek some form of authority some time in the future does not give that carrier any rights under Ashbacker")

Under the U.S.-Mexico aviation agreement, up to two U.S. carriers may be designated to serve a given city-pair market. Currently, both Comair and American Airlines, Inc. hold a designation to serve the Dallas/Ft. Worth-Guadalajara market. American is using its authority, but Comair's authority has become dormant. Under the circumstances presented, including our desire to make maximum use of our bilateral rights and in light of the fact that no party opposed American Eagle's application here, we will withdraw the designation of Comair and designate American Eagle in its place.

We have decided to deny American’s request. In making this decision, we have carefully reviewed the application, responsive pleadings, the language of the applicable law, and expressed legislative intent. Nothing we have found in our review indicates that American, as an incumbent with numerous DCA slots, satisfies the very high bar required to show exceptional circumstances. We conclude that the circumstances surrounding American’s application are not exceptional. Rather, they are typical of the circumstances attendant to an incumbent slot holder operating within a slot-controlled, high-density regime at DCA.
Prior orders show the same treatment of § 41714(d). American Eagle Airlines, Inc. hereby applies for a renewal of its exemption, last renewed by Notice of Action Taken in this docket on June 1, 2006, authorizing scheduled foreign air transportation of persons, property, and mail between Dallas/Ft. Worth, Texas and Torreon, Mexico. Absent this renewal application, American Eagle's exemption would expire on June 1, 2008.
American Eagle provides nonstop service between Dallas/Ft. Worth and Torreon using 46-seat ERJ-145 aircraft.
