Motion for Extension of Time to Answer Complaint
American Airlines, Inc., under 14 CFR 392.407, hereby moves for a six-week extension of time to answer the captioned complaint docketed by the Office of Aviation Enforcement and Proceedings (AEP) on April 25, 2003. Absent an extension, the answer date would be May 12, 2003. With the requested extension, the answer date would be June 23, 2003. AEP has authorized us to state that they agree to a two-week extension, or until May 26, 2003.
The requested extension will not delay the disposition of this proceeding. On May 5, 2003, the Honorable Burton S. Kolko issued a Notice of Hearing providing that pretrial discovery will end on August 29, 2003, and that the hearing will commence on September 30, 2003. American's requested answer date of June 23 is almost 10 weeks in advance of the end of discovery, and more than 14 weeks in advance of the hearing.
