OST-2005-22809 - Exemption - Codeshare with US Airways - US-Italy October 20, 2005 Application for Exemption and Statement of Authorization - Bookmarked Air One and US Airways entered into a Codeshare Agreement on September 1, 2005. Under the terms of this agreement, each party may put its designator code on the other party's flights; thus, Air One may sell seats for travel to or from the United States under its own name. However, at this time the parties contemplate only that Air One's flights within Italy will carry US Airways' code; US Airways flights will not carry the Air One code, nor will Air One will not operate its aircraft to or from any United States point. Air One is the leading Italian private airline company, and is the second largest airline in Italy. The Rome-based carrier operates over 1400 scheduled and charter passenger flights per week with a fleet of 30 Boeing 737s. The Air One network covers 25 cities in Italy, including the country's main economic and industrial areas. The company served over 5,730,000 passengers in 2004. Air One currently has in place codeshare agreements with a number of other foreign carriers, including Lufthansa and Air Canada. Air One is duly licensed by the Italian aviation authorities and has an excellent safety record. The codeshare activities contemplated are authorized by the bilateral aviation treaty between the United States and Italy. Approval of this application would be consistent with established Department of Transportation policies and past practices. Filed October 20, 2005 | Amended November 21, 2005 | Issued November 30, 2005 Exemption from 49 USC 41301 and statement of authorization under 14 CFR Part 212 to the extent necessary to engage in codeshare operations under which Air One would carry US Airways' designator code on flights it operates in Italy. Air One initially plans to carry US Airways code in the following city-pair markets: Rome(Flumicino), Italy, on the one hand and Alghero, Catania, Genoa, Lampedusa, Pantelleria, Palermo, Lamezia Terme, Trapani, Turin, Trieste, and Venice, on the other hand; and Venice-Bari. November 21, 2005 Amendment of Application for Exemption and Statement of Authorization Air One amends its application to remove the Rome-Milan (Linate) city pair from the list of Italian city-pairs covered by the Application. A revised Exhibit A, showing all city pairs now covered by the Air One's Application, is attached hereto. Counsel: Sher & Blackwell, Mark Atwood OST-2005-22809 - Exemption - Codeshare with US Airways - US-Italy October 11, 2006 Notice Concerning Additional Codeshare Points and Request for Waiver Air One S.p.A., pursuant to the Statement of Authorization granted in this Docket on November 30, 2005, hereby notifies the Department of additional code-share services to be operated by Air One, carrying US Airways' designator code, between the following city pair: Rome (Fiumicino) - Bari, Italy. Air One and US Airways wish to commence this service immediately upon confirmation by the Department, and Air One therefore requests a waiver of the 30-day prior notice requirement. Air One will poll the U.S. carriers on the attached service list to determine if there are any objections to this waiver. Counsel: Sher & Blackwell, Mark Atwood, 202-463-2513 OST-2005-22809 - Exemption - US-Italy Codeshare with US Airways November 29, 2007 Application for Renewal of Exemption Air One S.p.A., an Italian combination air carrier, hereby requests renewal for an additional two years of the exemption authority granted to it in the above-captioned docket permitting it to display the designator code of US Airways on flights operated by Air One between selected Italian cities. Air One respectfully requests that the Department renew the exemption granted to it in this docket for an additional two years. The Department of Transportation initially granted Air One's request for exemption authority on November 30, 2005, valid through November 30, 2007. At the same time, the Department issued a Statement of Authorization to Air One, which remains in effect indefinitely. See Notice of Action Taken in Docket OST-2005-22809, dated November 30, 2005. Currently, Rome-Catania/Genoa/Palermo/Lamezia/Terme/ Turin/Trieste/Venice. Air One hereby notifies the Department that it is not currently displaying US Airways' code on flights between Rome - Alghero/Lampedusa/Pantelleria/Trapani or Venice-Bari, but anticipates the near-term resumption of codesharing between these points. Air One will place its AP designator code on flights operated by United between Rome, Italy and Washington DC and connecting domestic and international flights. OST-2008-0073 - Exemption - Milan-Boston/Chicago February 25, 2008 Air One seeks exemption authority to provide service between Milan and Boston (five flights a week, commencing on June 14, 2008), and Milan and Chicago (six flights a week, commencing on June 21, 2008). Continuing service to points within the United States will be offered beyond Boston through US Airways and beyond Chicago through United Airlines, both Air One codeshare partners. Through this arrangement, Boston flights will continue to Washington DC, Philadelphia, and Phoenix, and Chicago flights will continue to Denver, Los Angeles and Seattle. By Notice of Action Taken dated November 30, 2005, in docket OST-2005-22809, Air One was granted an exemption and statement of authorization for codeshare operations under which US Airways would place its designator code on flights operated by Air One within Italy. Air One will shortly apply for expanded codeshare authority that would allow it to place its designator code on US Airways flights within the United States. An application for a statement of authorization for the Air One/ United codeshare, to allow each party to put its designator code on flights operated by the other party, was filed on December 31, 2007, and is currently pending in docket OST 2008-0001. Air One will provide required notice of the addition of the Chicago-Denver/Los Angeles/Seattle routes as these city pairs were not noted in the initial application. OST-2008-0072 - Foreign Air Carrier Permit - EU-US February 26, 2008 Application for a Foreign Air Carrier Permit - Bookmarked Air One seeks permit authority to provide service between any point or points in the European Union and any point or points in the United States with open intermediate and beyond points, commensurate with the U.S. -E.U. Open Skies Agreement. Air One initially plans to provide service between Milan and Boston (five flights a week, commencing on June 14, 2008), and Milan and Chicago (six flights a week, commencing on June 21, 2008). Continuing service to points within the United States will be offered beyond Boston through US Airways and beyond Chicago through United Airlines, both Air One codeshare partners.' Through this arrangement, Boston flights will continue to Washington DC, Philadelphia, and Phoenix, and Chicago flights will continue to Denver, Los Angeles and Seattle. As of February 2, 2008, Air One operated a fleet of 60 aircraft, consisting of a mix of Boeing 737, Airbus 320 and Bombardier CRJ900 aircraft. Information concerning these aircraft is attached as Exhibit C. Air One is in the process of dramatically increasing and upgrading its fleet. For the Europe‑U.S. service that is the subject of this application, the carrier intends to use A330 aircraft. The company has dry leased (from ILFC) two A330s, and intends to take delivery of one in early March, 2008, and the other in May 2008. The company plans to add four more dry‑leased A330s to its fleet in 2009, and has signed a letter of intent with Airbus for the purchase of twelve A330s for delivery between 2010 and 2012. In addition to these long‑haul aircraft, Air One is in the process of replacing its B737 aircraft with 90 new A320s, which will be used to provide Air One's intra‑Europe services. All aircraft owned or leased by Air One are used exclusively by the carrier. Air One is a citizen of Italy. The carrier is owned 99.77% by AP Holding S.p.A., which in turn is owned 99.99% by Toto S.p.A.; Toto S.p.A. is owned by 98% by Mr. Carlo Toto, an Italian citizen. Neither Mr. Toto nor Toto S.p.A. have any interest in any U.S. carrier. Within the Toto group of companies are other carriers and aviation‑related companies, including Air One Cityliner (which provides short range scheduled service within Italy); Air One Executive (which provides air taxi service); Air One Technic (which provides base maintenance services to Air One); and holding companies organized for the acquisition of Air One's new aircraft. OST-2008-0073 - Exemption - Milan-Boston/Chicago March 10, 2008 Amendment One to Application for Foreign Air Carrier Permit Air One S.p.A., the applicant in this proceeding, hereby amends its application in this docket to substitute two exhibits: Exhibit H - Preliminary 2007 Profit and Loss Statement, and Exhibit I - 2006 Financial Statements. Revised Exhibit H contains some additional information the Department may find useful, i.e. 2007 taxes and net income amounts, which were not previously available. Revised Exhibit I has been recalculated to correct an arithmetical error in converting Euros to U.S. Dollars. OST-2008-0073 - Exemption - Milan-Boston/Chicago Filed February 25, 2008 | Issued March 17, 2008 Exemption authority under 49 USC §40109 to engage in scheduled foreign air transportation of persons, property, and mail (1) between Milan, Italy (Malpensa Airport) and Boston, Massachusetts; and (2) between Milan, Italy (Malpensa Airport) and Chicago, Illinois. Air One states that the Milan-Boston service will commence on June 14, 2008, and the Milan-Chicago service will commence on June 21, 2008. The carrier further states that continuing service to points within the United States will be offered beyond Boston through US Airways, Inc. (expanded code-share application to be filed) and beyond Chicago through United Air Lines Inc. (see Notice of Action Taken, dated March 14, 2008, in Docket OST-2008-0001), both Air One code-share partners. Air One states that it will serve from/to Malpensa Airport. OST-2005-22809 - Exemption - US-Italy Codeshare May 2, 2008 Hereby seeks to amend the exemption authority and Statement of Authorization granted to it in the above-captioned dockets in order to expand its scheduled foreign and domestic air transportation of persons, property and mail pursuant to a codeshare agreement with United Airlines, by allowing the placement of United's designator code on Air One's transatlantic flights and amending Air One's exemption authority to allow Air One to place its AP designator code on United flights between Brussels and Washington D.C.. Air One also hereby provides notice of additional markets that Air One and United intend to serve under previously granted Department authority. Air One hereby seeks to amend its current exemption authority, granted in Docket OST-2005-22809 to allow it to codeshare with United on flights operated by United between Brussels, Belgium and Washington D.C., (and United's connecting U.S. and international flights). Air One further seeks to amend the Statement of Authorization granted in Docket OST-2008-0001 to allow it to display United's UA* designator code on flights operated by Air One between any point in Italy and any point in the United States. Air One and United also intend to serve additional markets under their previously‑granted codeshare authority. Attachment A contains (i) additional city pairs to be served under previously granted authority, and (ii) city pairs to be served under the additional authority requested herein. Should the Department have concerns about granting a statement of authorization that surpasses Air One's current exemption authority to operate Milan-Boston and Milan-Chicago, Air One asks in the alternative to amend the Statement of Authorization granted in Docket OST-2008-0001 to allow it to display United's UA designator code on flights operated by Air One between Milan and Chicago and between Milan and Boston, and to defer the remainder of this request until Air One's Foreign Air Carrier Permit for open E.U. -U.S. foreign air transportation has been granted. On February 25, 2008, Air One filed in Docket OST-2008-0073 an application for exemption authority' to engage in scheduled foreign air transportation of persons, property, and mail, using its own aircraft, (i) between Milan, Italy (Malpensa Airport) and Boston, Massachusetts; and (ii) between Milan, Italy (Malpensa Airport) and Chicago, Illinois. OST-2008-0001- Blanket Statements of Authorization - US-Italy Reciprocal Codeshare Filed May 2, 2008 | Issued July 10, 2008 Amendment of Air One's existing exemption authority under 49 U.S.C. 41301: Air One seeks to amend its current exemption authority granted by Notice of Action Taken dated March 14, 2008, so as to also allow Air One to place its designator code on flights operated by United Air Lines, Inc. between Brussels, Belgium, and Washington, D.C. (and United's connecting U.S. and international flights). Amendment of Air One's existing statement of authorization under 14 CFR Part 212: Air One seeks to amend its current statement of authorization granted by Notice of Action Taken dated March 14, 2008, so as to also allow Air One to display United's code on flights operated by Air One between any point in Italy and any point in the United States. The March 14, 2008, Notice of Action Taken authorizes Air One to engage in code-share operations under which Air One would carry the designator code of United on flights it operates within and beyond Italy, and to place its Air One designator code on Italy-U.S. services on flights operated by United between Italy and the U.S. (and United's connecting domestic and international flights). The March 14, 2008, Notice of Action Taken authorizes Air One to display United's "UA*" designator code on flights operated by Air One: (1) between any points within Italy in conjunction with services held out by United between the United States and Italy (either nonstop or via third country intermediate points); and (2) between any point in Italy and any point in a third country. The joint applicants state that, should the Department have concerns about granting a statement of authorization that surpasses Air One's current exemption authority to operate Milan-Boston and Milan-Chicago services, Air One seeks, in the alternative, amendment of its current statement of authorization "to allow it to display United's UA designator code on flights operated by Air One between Milan and Chicago and between Milan and Boston, and to defer the remainder of this request until Air One's Foreign Air Carrier Permit" has been issued authorizing open E.U.-U.S. foreign air transportation services (see Air One's pending foreign air carrier permit application in Docket OST-2008-0072). Specifically, we grant the applicants' requests to (1) amend Air One's existing exemption authority, in Docket OST-2005-22809, authorizing additional code-share services between Brussels, Belgium, and Washington, D.C. (and United's connecting U.S. and international flights), as described above; and (2) amend Air One's existing statement of authorization, in Docket OST-2008-0001, to allow Air One to display United's "UA*" code on flights operated by Air One between Milan and Chicago and between Milan and Boston (Air One holds the requisite underlying exemption authority to serve the Milan-Chicago and Milan-Boston markets (see Notice of Action Taken dated March 17, 2008, in Docket OST-2008-0073)). Air One does not currently hold the requisite underlying exemption authority to encompass the broad Italy-U.S. statement of authorization amendment requested in Docket OST-2008‑0001.
