Air Next Co., Ltd. hereby requests an exemption from 49 U.S.C. § 41301 and from such other applicable statutory of regulatory provisions of the Department as may be necessary to authorize Air Next to engage in scheduled air transportation of persons, property, and mail between a point in points or Japan, on the one hand, and a point or points in the United States, and to perform charters pursuant to 14 C.F.R. Part 212. Air Next also requests a blanket statement of authorization pursuant to Part 212 to the extent necessary to enable Air Next to display the UA* designator code of United Air Lines on flights operated by Air Next on a wet-lease basis for All Nippon Airways Co., Ltd. in connection with the existing code-sharing arrangement between ANA and United.

As of this date, Air Next operates a fleet of Boeing 737-500 aircraft. Air Next and ANA recently entered into a comprehensive wet-lease agreement under which Air Next wetleases its fleet to ANA.

By this application, Air Next seeks exemption authority, to the extent necessary, to engage in scheduled air transportation of persons, property, and mail between any point or points in Japan and any point or points in the United States, and to perform charters pursuant to 14 C.F.R. Part 212. Air Next intends to use the requested authority in connection with the codeshare arrangement between ANA and United. Air Next requests that the requested exemption authority be granted for a period of at least two years.

Beginning on April 1, 2007, Air Next will display United's UA* code on flights operated by it in certain domestic Japan city-pairs, and, thereafter, in other city-pairs in accordance with the operational needs of ANA and Air Nippon. Air Next may, in the future, wet-lease aircraft to ANA and display United's code in additional city-pairs, subject to the Department's standard 30-day advance notice provision.

The record indicates that the applicant is wholly-owned subsidiary of Air Nippon Co, Ltd. which is in turn wholly-owned by ANA.

Part 212. Air Next also requests renewal of its blanket statement of authorization pursuant to Part 212 to the extent necessary to enable Air Next to wet-lease aircraft to All Nippon Airways Co., Ltd. and display the designator code of United Air Lines on Air Next-operated flights wet-leased to ANA, as further described herein. Air Next requests renewal of the exemption authority and statement of authorization for a period of at least one year.
