Pursuant to 49 U.S.C. §40109 and Subpart C of the Department's Rules of Practice, Aero Personal, S.A. de C.V. hereby applies for renewal of its exemption from 49 U.S.C. §41301, which authorizes Aero Personal to engage in charter foreign air transportation of passengers between Mexico and the United States, and other passenger charter operations in accordance with 14 C.F.R. Part 212, using small aircraft. Aero Personal also requests renewal of its stopover privileges and continued relief from the Department's requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States.

Notice of Action Taken

Renewal of exemption from 49 USC § 41301 to permit the applicant to conduct passenger charter operations between Mexico and the United States, and other passenger charters in accordance with 14 CFR Part 212, using small equipment. The applicant also requests renewal of its stopover privileges and continued relief from the requirement to provide advance notice of each flight, or series of flights, between Mexico and the United States. Furthermore, the applicant requests that the authority be granted for a two-year term.

In the conduct of these operations, the carrier may only use aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds (small equipment). The one-year duration of the authority we granted is consistent with our usual policy of granting exemption authority in the circumstances presented. We, therefore, dismissed the application to the extent that it sought authority for a longer period.

Servicios Aereos M.T.T., S.A. de C.V., Transportes Aereos Mexiquenses, S.A. de C.V., and Aero Personal, S.A. de C.V. each requested that their authority be granted for a two-year term. As to Aeronaves TSM, S.A. de C.V., we have decided, on our own initiative and in the interest of administrative efficiency, to grant it exemption authority for a two-year term.
