February 20, 2007 American supports the Department's initiative to modernize the filing of aviation data, and trusts that by increasing efficiency in the filing process, the Bureau of Transportation Statistics will be able to increase efficiency in distributing the data to interested parties. American notes that "[s]elected Alaskan carriers are participating in an e-filing pilot program" (71 Fed. Reg. 76277). It is encouraging that this pilot program has yielded positive results; however, American hopes that the Department will be technically able to accept the significantly larger e-filings that carriers like American will be required to submit. We recommend that BTS utilize a SSL protocol for smaller filings and a SFTP mode of delivery for larger files. Incorporating a SFTP mode of delivery will reduce the manual intervention required for larger files. American assumes that once the Department issues a final rule in this docket, more details about the mechanics of the e-filing process will be made available to interested parties. To that end, American would welcome the opportunity to work with BTS to help implement the new e-filing system in order to minimize potential disruptions. Worth, Texas and Caracas, Venezuela. American initiated nonstop service between Dallas/Ft. Worth and Caracas on October 7, 1997, and presently uses 148-seat B737-800 aircraft (16F/132Y) to serve the route. American presently holds certificate authority to serve between Puerto Rico and Caracas (Route 542), and between New York/Miami and Caracas/Maracaibo (Route 543). Counsel: American, Carl Nelson, 202-496-5647, carl.nelson@aa.com OST-1999-5161 - Statement of Authorization US-Australia Codeshare with Qantas Filed January 17, 2007 | Approved February 20, 2007 Department Action on Application Application of American Airlines, Inc., for an Amended Statement of Authorization involving code-share services with Qantas Airways Limited between Los Angeles and Orlando, connecting to transpacific flights operated by Qantas from its Los Angeles gateway. In its application, American Airlines states that the Qantas “QF” designator code will be displayed on flights operated by American Airlines. The U.S.-Australia Air Transport Agreement authorizes the Government of Australia to select eight codeshare-only U.S. points that Australian airlines may serve. The selected U.S. points are Boston, Las Vegas, Miami, San Diego, St. Louis, Washington, Portland, and Phoenix. On January 17, 2007, the Government of Australia notified the United States that it will replace Phoenix with Orlando effective March 1, 2007. Order 2007-2-21 Issued January 4, 2007 | Served February 20, 2007 By Order 2006-12-12, issued December 13, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order. No objections were received within the time period provided. By: Paul Gretch Cathay Pacific Airways Limited OST-2000-6824 - Exemption - US-Hong Kong February 20, 2007 Application for Renewal of Exemptions By this application, Cathay seeks renewal of its exemption authority to engage in foreign air transportation of persons, property and mail by displaying its designator code on flights operated by American (1) between Hong Kong and 25 U.S. points beyond Cathay's U.S. and Canadian gateways; (2) between the United States and third-country points intermediate to Hong Kong connecting to Cathay flights between such points and Hong Kong, and (3) beyond the United States to third-country points. The exemption was last renewed by Notice of Action Taken, dated March 10, 2005, and is scheduled to terminate on March 10, 2007. Cathay seeks a two-year renewal of the authority. The currently selected points are Atlanta, Austin, Boston, Chicago, Dallas/Ft. Worth, Denver, Detroit, Ft. This notice will take effect for services on or after March 22, 2007. The proposed code-share services are consistent with the bilateral air transport agreement between the United States and Canada. Counsel: United, Julie Oettinger, 202-296-2370, julie.oettinger@united.com OST-1995-299 - Exemption - Miami-Bonaire February 20, 2007 Application for Renewal of Exemption Authority United Air Lines, Inc. hereby applies for renewal of an exemption from 49 U.S.C. § 41101 authorizing it to provide scheduled foreign air transportation of persons, property, and mail between Miami, Florida and Bonaire, Netherlands Antilles and to co-terminalize its Bonaire services with services to Curacao, Netherlands Antilles, and Port-au-Prince, Haiti. The exemption authority, as amended, is currently effective through April 27, 2007. Untied requests that this exemption authority be renewed for a minimum period of two years. On January 11, 2002, United notified the Department that its code-share arrangement with Air ALM was terminated. However, United would like to renew its exemption authority, so that it may utilize this authority to serve Miami-Bonaire with another code-share partner in the future. Renewal of this authority would give United the flexibility to quickly start services with a new code-share partner. Counsel: United, Julie Oettinger, 202-296-2370, julie.oettinger@united.com Served February 20, 2007 Notice Announcing an Extension of Time to File Answers to Objections to Order 2006-12-23 On February 14, 2007, Virgin America, Inc. filed Motions requesting confidential treatment of certain additional evidentiary material and for leave to file this material out of time, supporting its request for a certificate of public convenience and necessity under 49 U.S.C. § 41102 to engage in interstate scheduled air transportation. We will grant Virgin America's request to file out of time and we will address its request for confidential treatment by separate action. (See Order 2006-12-23, issued December 27, 2006, in which the Department tentatively concluded that Virgin America is not a U.S. citizen as defined in 49 U.S.C. § 40102(a)(15) and proposed to deny its application for interstate scheduled air transportation of persons, property, and mail under 49 U.S.C. § 41102. Virgin America filed its Objections to our tentative decision on January 18, 2007, and filed supplementary material on January 30. Answers to Objections have been filed.) Given the circumstances in this case, and in an effort to have a complete record for decision, we find it in the public interest to provide interested parties an additional seven business days from the service date of this Notice to file answers, addressing this new material.
