OST-02-12131 - U.S.- Colombia Scheduled All-Cargo Services March 4, 2004 Application for Renewal of Exemption Authority By Notice of Action Taken, dated May 13, 2002, the Department granted Evergreen exemption authority to engage in scheduled foreign air transportation of property and mail from points in the United States, via intermediate points, to points in Colombia and beyond to points in the Western Hemisphere. The Notice also authorized Evergreen to integrate this authority with its other exemption and certificate authorities. The exemption and integration authorities are scheduled to expire on May 13, 2004. Although Evergreen currently is not utilizing its U.S.‑Colombia authority, it continues to have a strong interest in serving the market, and believes that, when economic conditions warrant, it will be able to offer a pattern of service in combination with services offered to other South American countries. Thus, the company wishes to retain its exemption and integration authority so that it has the ability to serve the market at the appropriate time. Provision of such service clearly will benefit shippers and receivers and is in the public interest. In addition, given the open nature of the cargo annex to the U.S.‑Colombia air transport agreement, renewal of the exemption will not deprive any other U.S. carrier of the opportunity to serve the market. Worth- Points in Mexico March 4, 2004 Application for Renewal of Exemption Hereby applies for a renewal of a two-year exemption previously granted by the Department in order to provide scheduled foreign air transportation of persons, property and mail between Minneapolis/St Paul (MSP) and the following points in Mexico: Cancun (CLJN); Cozumel (CZM); Puerto Vallarta (PVR); Mazatlan (MZT); Manzanillo (ZLO) and Ixtapa/Zihuatanejo (ZIH), and between Dallas/Ft. Worth (DFW) and Cancun (CUN). Sun Country plans to commence once weekly seasonal service in the MSP‑ZIH market in January through April of 2005, according to the attached schedule. Sun Country will provide this new service utilizing Boeing 737‑800 aircraft, with either 168 or 184 seats. All Sun Country Airlines service to Mexico currently utilizes that aircraft. Because MSPZIH service is now dormant, Sun Country requests that the Department reactivate that exemption authority, in addition to granting the renewal of the subject exemption. In its Notice of Action Taken-Docket OST-2002-12211, the Department granted Sun Country a two-year exemption to operate the above referenced service. The exemption is effective through May 30, 2004. Sun Country is currently providing scheduled seasonal service in all of the above referenced markets, with the exception of MSP-ZIH, for which exemption authority is currently dormant. (See Attached Service Schedule). Pursuant to the Department's Notice of Action Taken, Sun Country also holds exemption authority in the DFW-CZM and DFW-PVR markets, both of which are currently dormant. Sun Country has no firm plans at this time to commence service in those markets, and does not, therefore, include those city-pairs in this Application for Renewal. However, Scott Aviation did not detail the underlying assumptions associated with this forecast. Therefore, please provide the number of flight hours reflected in this forecast, along with the average expenses per block hour assumed. Further, state why we should accept the company's forecast as reasonable. The company states that all of its indirect operating costs are and will be covered by its ongoing Part 135 operations. However, in order for the Department to assess whether Scott Aviation has the necessary funding to meet our financial fitness test, the company must provide a detailed pre‑operating cost forecast that reflects the costs directly associated with Scott Aviation's Part 121 certification. Please provide this forecast accompanied by detailed notes on all assumptions used. To the extent that these Part 121 associated expenses are being paid as incurred, please so note and separately identify all expenses that will remain outstanding on the first day of Scott Aviation's DC‑9 start of service. Nn March 3, 2004, we orally acknowledged the registration of the trade names "US Airways Express" and "MidAtlantic Airways" by US Airways for use in its operations. The company currently conducts operations under the trade names "US Airways," "US Airways Shuttle," "US Air," and "Metrojet." MidAtlantic Airways, Inc. f/k/a Potomac Air, a wholly owned subsidiary of US Airways Group (which is also US Airways' parent), ceased operations in October 2001, and its commuter air carrier authority was revoked in July 2003 (see Order 2003-7-38) Our registration of the trade name "MidAtlantic Airways" authorizes US Airways to conduct operations using the trade name "MidAtlantic Airways;" this in no way implies that MidAtlantic Airways, Inc. f/k/a Potomac Air holds any authority to conduct air transportation.
