Documentation from the depository bank, North Fork Bank, that today Aerolineas made a deposit into the escrow of U.S. $28,254.85, will be sent when received from the bank. You will notice that the amount due has been adjusted to reflect the fact that the Aerolineas estimated payment was higher than the actual amount due, when compared with the bills received from the Argentine FAA and Aeropuertos 2000, by the amount of U.S. $330.69. As shown, that amount has be deducted from this sixth report. By: Paul Gretch OST-03-16716 - Certificate - Foreign Scheduled Air Transportation March 1, 2004 Re: Information Request from Air Carrier Fitness We have completed our initial review of the applications filed on December 12, 2003, by Blackstar Airlines, Inc. for the determination of its fitness to conduct scheduled passenger operations as a certificated air carrier. An applicant for certificate authority is expected to be prepared to fully prosecute its application at the time it is filed. With respect to financial fitness, the applicant is required to provide historical and current financial data, together with a detailed forecast of its pre-operating costs and a pro-forma forecast profit and loss statement reflecting all revenues and expenses the applicant expects to earn/incur during its first year of scheduled passenger operations. In addition, the company must demonstrate that it has obtained all of the funding needed to meet our financial fitness test or, at a minimum, that it has a reasonable plan for doing so. While Blackstar has submitted a copy of its Private Placement Memorandum, it has not supplied detailed verifiable information to support its current financial condition, nor its ability to carry out the Private Placement. Typically, we expect an applicant to support its funding plans with, at a minimum, independent third-party verification of all funds currently available, together with other information relative to the status of its PPM. Further, G&C has submitted evidence that it has obtained the requisite insurance for its large aircraft operations. Therefore, the only outstanding requirement that must be met before we can make G&C's certificate authority effective for large aircraft operations is our receipt of evidence that the FAA has amended the carrier's Operations Specifications to add the aircraft at issue. The purpose of this letter is to advise you of our intent to reissue G&C's interstate and foreign certificates reflecting. the effectiveness of the large aircraft authority (cargo only) contained therein upon G&C' s receipt of the amended Operations Specifications noted above. However, as is our current practice, we will limit the number of large aircraft authorized to that presented in G&C's September 17, 2003, filing, as this reflects the basis for our fitness determination. Therefore, G&C will not be able to operate more than one large aircraft under the reissued certificate without obtaining further approval from this office. Of course, this aircraft number limitation does not in any way restrict G&C's ability to operate small aircraft. The service to be operated by Spirit will not be markedly different in terms of aircraft size or stage length from the Ft. Lauderdale-Cancun service or other services Spirit currently operates. Under the U.S.-Mexico Bilateral Air Service Agreement, the United States may designate up to two U.S. carriers to serve each eligible U.S-Mexico city-pair. At present, Northwest Airlines is designated to provide service between Detroit and Cancun, leaving one additional designation available for allocation. Northwest - OST-98-3844 - OST-99-6319 - Order 2000-5-31 - Certificate As Spirit understands, Continental holds authority to hold out codeshare service in the Detroit‑Cancun market by placing its code on services operated by Northwest. Spirit understands that this authority should not affect Spirit's plan to hold out its own direct service in the market. Spirit has been serving the Ft. Lauderdale-Cancun market since December 2003.
