Re: Proposal of Mesa Air d/b/a Air Midwest

Cordially submits a proposal to provide Essential Air Service to Alamosa, Pueblo, and Cortez Colorado. Mesa proposes to submit a combination of one stop and non stop service between Alamosa, Pueblo, and Cortex airports with two and three round trip options each weekday, and two round trip options each weekend to Denver and Phoenix. We are also proposing options to Albuquerque with trips daily. All flights will be operated with a pressurized turboprop Beech 1900 D aircraft with 19 seats. The selection of Mesa Air Group Inc. d/b/a Air Midwest combined with the extensive route structure America West and United would provide the best service within the future of the program. The selection of Mesa would not only be an upgrade in air service, but will also help continue the growth within the community. Enclosed please find our proposal which includes the benefit analysis of the level of service that could eventually be unsubsidized.

Motion for Confidential Treatment Pursuant to Rule 12

Since its September 17, 2003 request, Gulf & Caribbean has on three occasions provided additional information to the Department to enable it to assess the fitness of the carrier to conduct operations with large aircraft. Most recently, by letter dated January 20, 2004, Gulf & Caribbean provided a detailed list of the flights it had conducted between April 2002 and December 2003 using a Convair 580 aircraft leased from the IFL Group, Inc. The detailed flight information, which is the subject of this Motion, was submitted in response to the Department's inquiry concerning whether the carrier had undergone a substantial change in its operations after its acquisition in 2003 by Air Apparent, LLC.

On February 13, 2004, the Department requested that Gulf & Caribbean file the January 20, 2004 letter in the above referenced Docket and submit a Rule 12 motion if Gulf & Caribbean desired confidential treatment for the flight information.

This is in response to your e-mail to me in my capacity as counsel for Gulf & Caribbean Cargo, Inc. dated January 5, 2004 asking whether as a result of the acquisition of G&C there were any substantial changes in the operations of G&C. In your e-mail you note that G&C aircraft, according to the FAA, have been operating out of Pontiac, Michigan and that this information would indicate that the operations of G&C may have changed since its acquisition in 2003 by Air Apparent.

Application for Statement of Authorization

Hereby applies for a statement of authorization under 14 C.F.R. § 212 in order to display the "UA' designator code of United Air Lines, Inc., for the transportation of U.S. mail on scheduled Gulf Air flights between London, Paris, Frankfurt, and Hong Kong, on the one hand, and Bahrain, on the other, and beyond to Abu Dhabi, UAE; Baghdad, Iraq; and Muscat, Oman, pursuant to a codesharing agreement with United under which United will transport the mail in question on United flights between points in the United States, on the one hand, and London, Paris, Frankfurt, and Hong Kong on the other. Initially Gulf Air and United plan to implement their codesharing arrangement via connections between United and Gulf Air flights at London. A redacted copy of the Agreement between Gulf Air and United is attached to this Application.

The exemption and statement of authorization issued to Gulf Air to codeshare with American Airlines via London remains in effect due to a timely-filed renewal application invoking the automatic extension provisions of the U.S. Administrative Procedure Act. In compliance with the Paperwork Reduction Act of 1995, Public Law 104-13, the Office of the Secretary invites the general public, industry and other governmental parties to comment on the need for and usefulness of the Department's collecting three new quarterly reports from intra-Alaska air carriers required by the Rural Service Improvement Act of 2002 (RSIA) consisting of: Passenger, freight, and charter revenue by market by direction; a more detailed system income statement; and system excise taxes paid on passengers and freight. The reports would be required of all intra-Alaska carriers intending to qualify for the carriage of bush mail from the Postal Service.

Written comments should be submitted by April 26, 2004.

AirTran requested four (4) within perimeter slot exemptions to provide two additional daily roundtrip flights between DCA and Hartsfleld‑Jackson International Airport ("AlL") to enhance its existing limited service in that market and to dozens of connecting small and medium communities. AirTran is the carrier that meets this criteria.

Application for Renewal of Exemption

Sundance Air Venezuela's renewal application is limited in scope and is non-controversial. Transportation services proposed by Sundance Air Venezuela are substantially identical to those it performed between Venezuela and the United States during the past year, i.e., charter transportation of cargo using wet leased aircraft.

The Direccion General de Transporte Aéreo of the Republic of Venezuela has authorized Sundance Air Venezuela to conduct international cargo operations pursuant to a wet lease arrangement with Sundance Air, Inc., a U.S. air taxi operator. In like manner, the Federal Aviation Administration has issued Operations Specifications to Sundance Air, Inc. authorizing the company to provide wet lease operations for Sundance Air Venezuela. Sundance Air Venezuela continues to wet lease Beech 1900C and Beech 99C aircraft from Sundance Air, Inc., a U.S. air taxi operator.

Application for an Exemption

Hereby applies for an exemption and, to the extent necessary, designations in order to engage in scheduled foreign air transportation of persons, property and mail (1) from points behind the United States via the United States and intermediate points to a point or points in Turkey and beyond; and (2) from points behind the United States via the United States and intermediate points to a point or points in Portugal and beyond. US Airways is also applying herein for route integration authority to combine this exemption authority with US Airways' other authorities. US Airways plans to serve Turkey and Portugal, respectively, from the United States via Germany pursuant to its code-sharing agreement with Deutsche Lufthansa AG.

As the Department is aware, US Airways has entered into a code-share agreement with Lufthansa whereby US Airways places its code ("US") on certain flights operated by Lufthansa and Lufthansa places its code ("LH") on certain flights operated by US Airways. US Airways already has broad beyond-Germany authority for codesharing with Lufthansa. See Amended Notice of Action Taken, October 16, 2003 (Docket OST-03-15946).

Although US Airways plans at this time to offer these Portugal and Turkey services on a code‑share basis with Lufthansa, US Airways may, in the future, operate its own services in these markets or code‑share in these markets with other partners, including United Air Lines, as opportunities present themselves. Accordingly, US Airways seeks broad "all points" authority in order to obviate the need to file another application (requiring additional time and Department resources) in the future should additional code‑share services or services operated by US Airways be warranted.

This will serve as notice to the Department, pursuant to the requirements of the Notice of Action Taken in this Docket, dated December 10, 2003, that Kalitta Air, L.L.C. intends to commence scheduled twice-weekly Incheon-Hong Kong all-cargo service with full traffic rights on March 10, 2004. This will employ both of the Korea - Hong Kong Fifth Freedom frequencies that Kalitta Air was awarded in this proceeding, within the 90-day startup extension granted by the NOAT referenced above.
