OST-2008-0073 - Exemption - Milan-Boston/Chicago March 10, 2008 Amendment One to Application for Foreign Air Carrier Permit Air One S.p.A., the applicant in this proceeding, hereby amends its application in this docket to substitute two exhibits: Exhibit H - Preliminary 2007 Profit and Loss Statement, and Exhibit I - 2006 Financial Statements. Revised Exhibit H contains some additional information the Department may find useful, i.e. 2007 taxes and net income amounts, which were not previously available. Revised Exhibit I has been recalculated to correct an arithmetical error in converting Euros to U.S. Dollars. OST-1998-4031 - Exemption - US-Prestwick/Glasgow Cargo March 10, 2008 Application for Renewal of an Exemption Atlas requests two-year renewal of its exemption authorizing it to provide scheduled foreign air transportation of property and mail between a point or points in the United States and Prestwick/Glasgow, Scotland. Atlas has operated US-Prestwick/Glasgow services and has need for this authority. The authority expires April 21, 2008 and Atlas accordingly requests that its exemption authority be renewed in advance of that date. Counsel: Atlas Air, Russell Pommer, 202-822-9121, rpommer@atlasair.com OST-2000-7668 - Certificate of Public Convenience and Necessity - Interstate Scheduled Service March 10, 2008 Answer of the Air Line Pilots Association to Objections and Comments of Boston-Maine In ALPA's view, BMACs senior owners and officers have demonstrated a lack of compliance disposition at companies other than BMAC that they own and manage as well sufficient to warrant certificate revocation. Indeed, ALPA's December 29, 2004 motion to revoke BMACs certificate is based solely on a number of decisions of courts, arbitrators and administrative bodies that found that such companies had violated a range of laws and contractual commitments. The Department is clearly correct in proposing to revoke all BMACs authority. The repeated submission over a two and one-half year period of patently false documents in this proceeding -- a sustained course of malfeasance which may be without parallel in the Department's history -- as well as the numerous other demonstrations of a lack of compliance disposition contained in ALPA's petition to revoke bear directly on the fitness of BMACs owners and senior managers to operate any airline. Although Adak is not located within our Borough boundaries, we recognize the service Alaska Airlines is currently providing is critical for the continued access and economic well being of Adak as well as that of this entire region of our state. By: Robert Juettner Essential Air Service at Crescent City, California March 6, 2008 Our proposal is to continue our current service pattern of two daily round trips to San Francisco, and one daily round trip to Eureka which provides connections to the state capital Sacramento. Service will be with the 30 passenger Embraer Brasilia aircraft which is a twin turboprop, two crew, one flight attendant, and pressurized aircraft. These flights will all be flown as United Express, providing connections in San Francisco to the national transportation system. By: Eric Christensen Essential Air Service at Manistee/Ludington, Michigan February 28, 2008 Manistee County Blacker Airport Authority in Support of Great Lakes Aviation We are responding per request on service at Manistee, Michigan for EAS service by Great Lakes Airlines. We switched from Chicago O'Hare to Milwaukee only because we were very familiar with Midwest Airlines reputation. Since Midwest airlines has been in Manistee our traffic has more then doubled. Reasons for traffic increase are great schedule, meeting all Midwest connections in and out of Milwaukee, competitive fares (when Midwest came here they called their fare structure "Southwest type fares"), and near 100% completion of all flights. They have continued that fare structure since starting in Manistee. We would support the Great Lakes proposal based on operating as a Midwest Connect carrier. This would include same schedules and Midwest fare structures. We have no objections with Great Lakes code sharing with other airlines in Milwaukee as long as they maintained the Midwest connection. March 7, 2008 St. Lawrence Valley Air Task Force in Support of Cape Air Awarding EAS service to Cape Air will assure that the carrier needs of three airports will be met, and brings a capable airline to this region that has indicated a potential to grow with us, and to provide larger planes at the appropriate time. Watertown's desire for the larger planes that Gulfstream proposes should not be placed above the only bid proposal on the table that will assure that the needs of all three airports will be met. CanJet Airlines OST-2002-13814 - Exemption - Canada-US Charter Passenger March 10, 2008 Application for Renewal of an Exemption CanJet hereby applies for renewal of its temporary exemption from 49 U.S.C § 41302 authorizing CanJet to perform transborder scheduled and charter flights carrying persons, property and mail between any point or points in Canada and any point or points in the United States pursuant to the February 1995 Bilateral Air Transport Services Agreement between Canada and the United States, as amended as most recently granted by Notice of Action Taken issued on March 19, 2007, through March 19, 2008. CanJet requests that the foregoing exemption authority be granted for a period of two years, through March 19, 2010, or until 90 days after final action by the Department on a forthcoming application by CanJet for a Foreign Air Carrier Permit pursuant to 49 U.S.C. § 41302 authorizing the same broad-scope transborder operations, whichever occurs first. Counsel: Hogan & Hartson, Sheryl Israel, 202-637-8898, sisrael@hhlaw.com Northwest Airlines, Inc. and Northwest Airlink Carriers and Societe Air France, Brit Air, City Jet and Regional OST-2007-0107 - Exemption and Statement of Authorization - Blanket Codesharing March 11, 2008 Application to Modify Statements of Authorization In the applications for the statements of authorization granted, Northwest and the Air France Regionals requested, for administrative purposes, that these codeshare authorizations be consolidated into Docket OST-2004-19214, the Docket established by the Department for the administration of the grant of blanket statements of authorization to engage in reciprocal codesharing issued to Northwest and Air France, and that future codeshare notices for one Air France Regional be deemed notice filed by Air France and other Air France Regionals as well. Although both NOATs recite the request for consolidation as part of the relief requested and indicate "approval," the applicants' specific requests for relief such that "any future code-share notice given for Air France [or an Air France regional carrier] be deemed as notice given for either carrier" were either overlooked or never expressly granted. See NOAT dated March 4, 2008, Docket OST-2007-28643. Therefore, Northwest and the Air France Regionals request that the following footnote, substituting the Air France Regional carrier names where appropriate, be added to the codeshare conditions included in each of the NOATs cited above:
As a result of the Department's footnote, it is clear in the case of Northwest and the Northwest Airlink Carriers that a codeshare notice for one Northwest carrier will be deemed as notice for all the other Northwest carriers. Thus, similar treatment should be granted in connection with the Northwest/Regional and Northwest/Brit Air/CityJet statements of authorization, and the NOATs dated February 25 and March 4, 2008 should be modified with the addition of the footnote text identified in italics above. United Air Lines, Inc. and Turkish Airlines (Turk Hava Yollari, A.O.) OST-2008-0102 - Statement of Authorization - US-Turkey and Beyond Codesharing March 11, 2008 Joint Application - Bookmarked United requests a Statement of Authorization for blanket code-share authority to display THY’s “TK” designator code on flights operated by United 1) between any point in the United States and any point in Turkey (either nonstop or via third-country intermediate points); 2) between any points within the United States in conjunction with services held out by THY between Turkey and the United States (either nonstop or via third-country intermediate points); and 3) between any point in the United States or Turkey and any point in any third country. THY requests a Statement of Authorization for blanket code-share authority to display United’s “UA” designator code on flights operated by THY 1) between any point in Turkey and any point in the United States (either nonstop or via third-country intermediate points); 2) between any points within Turkey in conjunction with services held out by United between the United States and Turkey (either nonstop or via third-country intermediate points); and 3) between any point in Turkey or the United States and any point in any third country. United also requests an amendment of its exemption authority in Docket OST-2004-19148 to enable it to provide third-country code-share services to any point worldwide under THY’s Statement of Authorization for blanket code-sharing with United. Because THY’s Open Skies authority already allows it to hold out service to any third-country point intermediate to or beyond the U.S. or Turkey, THY does not require additional traffic rights to provide the services at issue. United currently operates no passenger service in its own aircraft between the U.S. and Turkey. By placing the UA code on THY’s nonstop flights between its U.S. gateways and Istanbul and services between certain of United’s European gateways and Turkey, United will be able to expand its passenger service to offer additional consumer choices the U.S.-Turkey market. In addition, by code-sharing with THY, United will be able to hold out a greater range of services to other points intermediate to and beyond Turkey. THY, for its part, will be able to hold out service on a code-share basis on United’s flights between the U.S. and United’s European gateways via connections from THY’s services between Turkey and these European points. THY will also offer code-share services to points within the U.S. from THY’s transatlantic gateways at New York and Chicago. The Joint Applicants hereby notify the Department that they plan to commence code-sharing on the city-pair routes listed in Appendix A hereto, effective as soon as all necessary government authorities have been received. The U.S. points to be served by THY beyond its own and United’s U.S. gateways include points served by both United and United Express. United and THY understand that in order for THY to code share on services operated by United Express carriers, such carriers will have to enter into code-share agreements with THY and obtain Statements of Authorization from DOT.
