Application for Amendment to Foreign Air Carrier Permit and Exemption Authority - Bookmarked

Iberia hereby requests an amendment to its foreign air carrier permit so that the authority granted by such permit will reflect the full extent of the rights of Community airlines under the Air Transport Agreement Between the United States and the European Community and the Member States of the European Community. Specifically, Iberia seeks blanket open skies authority to enable Iberia to engage in: a) scheduled and charter foreign air transportation of persons, property and from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) scheduled and charter foreign air transportation of persons, property and mail between any point or points in any member of the European Common Aviation Area and any point or points in the United States; c) scheduled and charter all-cargo foreign air transportation between any point or points in the United States and any other point or points; d) other charters subject to the Department's regulations in 14 C.F.R. Part 212; and e) transportation authorized by any additional route rights made available to European Community airlines in the future.

Iberia also requests exemption authority under 49 U.S.C. § 40109 to the extent necessary to enable it to engage in the above-described operations pending issuance of an amended foreIgn air carrier permit. Iberia asks that the open skies authority requested herein become effective on March 30, 2008.

Correction to Comments of American Airlines and American Eagle Airlines

American Airlines, Inc. and American Eagle Airlines, Inc. file this correction to the comments they originally submitted in this docket on March 9, 2005.

On page 8 of the comments, in the first line of the third paragraph, the word "not" should have appeared between the words "does" and "think." Given the context and the remainder of the paragraph, American and American Eagle believe it is apparent the word "not" was inadvertently omitted, but formally submit this correction to the comments nonetheless.

Application for an Amended Foreign Air Carrier Permit and Exemption Authority

Star Air A/S requests that the Department amend Star Air's existing Foreign Air Carrier Permit, which was issued by Order 2007-10-15, to incorporate the new rights made available to European air carriers pursuant to the Air Transport Agreement between the United States and the European Community and the Member States of the European Union). Star Air also requests related exemption authority pursuant to 49 U.S.C. § 40109 to the extent necessary to enable it to provide the services covered by this Application while the Department evaluates Star Air's Application to amend its Foreign Air Carrier Permit.

Star Air requests that the Department grant it the right to provide the following: a) Foreign scheduled and charter air transportation of property and mail from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond; b) Foreign scheduled and charter air transportation of property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; c) Foreign scheduled and charter cargo air transportation between any point or points in the United States and any other point or points; d) Other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and e) Transportation authorized by any additional route rights made available to European Community carriers in the future.

The Office of the Assistant General Counsel for Aviation Enforcement and Proceedings, pursuant to Your Honor's March 22, 2006 Order staying this proceeding, files this report detailing the current status of this proceeding and settlement negotiations.

The Department has not ruled on the outstanding motions filed by Respondents and opposed by the Enforcement Office in Ascend Aviation Group, Docket OST-2004-17486.

There have been no further settlement discussions.

This report was due the last Friday of the month, or January 25, 2008. The Enforcement Office apologizes for having inadvertently missed that submission date.
