OST-2008-0044 - Statement of Authorization - Blanket Codesharing January 29, 2008 Joint Application for Blanket Codesharing Authorizations American Airlines, Inc. (and its affiliates American Eagle Airlines, Inc. and Executive Airlines, Inc. d/b/a American Eagle) and Iberia Lineas Aereas de Espana, S.A. hereby jointly apply under 14 CFR Part 212 for blanket statements of authorization, subject to 30-day notice, in order to engage in reciprocal codeshare services under the U.S.-EU open skies agreement, which takes effect on March 30, 2008. The authority requested will replace the limited codeshare rights now held by American and Iberia that were initially granted by Notice of Action Taken (undocketed), August 6, 1998, under the bilateral U.S.-Spain Air Transport Agreement. Effective March 30, 2008, American will hold all necessary underlying route authority on its open skies certificate for Route 835, issued by Order 2007-4-2, April 1, 2007. Iberia is contemporaneously herewith submitting an application for exemption authority and for an amended foreign air carrier permit reflecting open skies effective March 30, 2008. Iberia will similarly hold all necessary underlying route authority under such open skies exemption authority and amended foreign air carrier permit. OST-2008-0045 - Exemption - US-Guyana January 29, 2008 Delta hereby applies for an exemption authorizing Delta to provide scheduled foreign air transportation of persons, property, and mail between any point or points in the United States and any point or points in Guyana. Specifically, Delta requests that, as soon as possible, the Department issue a single Order: (1) awarding Delta a certificate of public convenience and necessity for U.S.-Guyana per its pending application in Docket DOT-OST-1999-6246; or (2) issuing Delta (i) the requested U.S.-Guyana exemption authority for a period of two years or until 90 days after the Department's final determination on Delta's certificate application, whichever occurs first, and (ii) tentative approval of the corresponding certificate of public convenience and necessity under the show-cause procedures described in the Streamlined Licensing Procedures Notice. If the Department proceeds under option (2), as soon as possible thereafter, the Department should issue a Final Order granting Delta's U.S.-Guyana certificate, valid for an indefinite duration. Delta plans to operate nonstop service between New York (JFK) and Georgetown, Guyana, four times weekly on a year-round basis using B-757 aircraft with 183 seats. OST-2007-29356 - Exemption and Allocation of Frequencies - New York-Cape Town via Dakar Filed January 16, 2008 | Issued January 29, 2008 Allocation of four U.S.-South Africa frequencies for the scheduled foreign air transportation of persons, property and mail between New York, New York and Cape Town, South Africa, via Dakar, Senegal. Under the U.S.-South Africa aviation agreement, U.S. carriers may operate 21 weekly scheduled combination frequencies. By Notice of Action Taken dated October 16, 2007, in the instant docket, the Department allocated three of those frequencies to Delta to serve between New York and Cape Town via Dakar leaving a total of 11 frequencies available for allocation. Delta’s current request for 4 frequencies to serve between New York and Cape Town via Dakar will leave a total of 7 frequencies available for allocation. By: Paul Gretch Enhancing Airline Passenger Protections January 22, 2008 Comments of the Air Transport Association of America ATA does not agree with the Department’s suggestion to require on-time performance reporting for international flights. International operations present a unique and different dynamic than domestic operations. For example, it is not unusual for carriers to purposefully hold an international flight for passengers who are delayed on an inbound connecting flight. Carriers do this as a positive customer service because such a flight may be the only operation to an international point for the day or even the week. With fewer flights on international segments, purposeful delays are important because leaving a passenger behind may result in stranding a passenger at an airport in a foreign country for an entire day or overnight. Carriers should not be penalized by having to report such delays. In addition, as wind speeds tend to be stronger over the oceans, carriers can face significant delays in travel when flying against prevailing winds. The result of international on-time reporting most likely would be for carriers to not wait for connecting passengers, stranding them in a foreign country for long periods of time. Therefore, ATA does not see a benefit to the public for international on-time reporting. In that letter Mayor Phillips requested that the Department of Transportation take measures to prevent Air Midwest, Inc. from terminating service to Manhattan until a suitable replacement carrier is named. In order to expedite the selection of a replacement carrier, and to minimize the impact of Air Midwest's action on this region, on behalf of the City of Manhattan, I request that the Department of Transportation immediately vacate Order 2007-12-25 awarding a 2008-2010 Essential Air Service contract to Air Midwest, Inc. and instead award the contract to Great Lakes Aviation, Ltd. in accordance with their proposal submitted October 30, 2007.
