Application for Allocation of Four Additional US-South Africa Frequencies

Hereby applies for an allocation of four additional U.S.-South Africa frequencies for Delta's scheduled foreign air transportation of persons, property, and mail between New York, New York, and Cape Town, South Africa, via Dakar, Senegal. With these additional frequencies, Delta will be able to offer U.S. passengers daily service to Cape Town, complementing its current daily Atlanta-Dakar-Johannesburg service and further establishing Delta as the leader in the provision of quality of U.S.-flag service to Africa.

Delta's proposed additional flights between New York and Cape Town, South Africa, via Dakar, Senegal, will operate, beginning on or about June 3, 2008, using Boeing 767-300ER aircraft configured with 185 coach and 36 BusinessElite seats.

Delta seeks an allocation of four of those available frequencies so that it may increase its current thrice weekly one-stop New York-Cape Town offering to daily service. Thus, even after granting the frequency allocation requested herein, there will still be seven unused U.S.-South Africa frequencies available for allocation to other carriers.

DOT proposes to modify a system of records under the Privacy Act of 1974. The system is DOT’s Docket Management System, which is being modified to reflect: (1) Incorporation in the new Governmentwide Federal DMS; (2) relocation of DOT’s Headquarters Building, in which DMS is located; and (3) new name of the organizational entity of which DMS is a part, and its location in the new DOT HQ. This system would not duplicate any other DOT system of records.

This notice will be effective, without further notice, on February 26, 2008, unless modified by a subsequent notice to incorporate comments received by the public. Comments must be received by February 19, 2008 to be assured consideration.

Comments of Jet Airways (India)

Concerning a determination of what constitutes the "largest" foreign carriers (i.e., those that should be subject to the contemplated on-time reporting requirements), Jet Airways urges the Department to adopt an approach that (a) minimizes administrative burdens on the greatest number of operators possible (particularly smaller airlines, which are less likely to have sufficient resources to commit to additional reporting requirements) and (b) places all reporting airlines -- both U.S. and foreign -- on an equitable footing, while maintaining the Department's ability to collect meaningful data. To that end, it would seem reasonable to consider both (1) the number of weekly flights a foreign airline performs to U.S. airports overall, and (2) the concentration of international flights operated by a single foreign airline at each international gateway. For instance, all foreign airlines that operate, e.g., 70 or more weekly frequencies (i e., 10 daily flights) to and from the United States could automatically be included as a reporting carrier, and any foreign airline that exceeds a certain threshold at a relevant U.S. gateway (e.g., 10% of scheduled international departures at Airport X), irrespective of how many flights it operates to the United States overall, could also be required to report with respect to its flights at that specific gateway.

Given that Jet Airways operates relatively few international flights at the U.S. gateways it serves (Newark, JFK and, in the future, San Francisco), by either measure it proposes, Jet Airways would most likely not be required to report on-time data in the near term. However, in the event the Department determines that Jet Airways' current level of operations to the United States does warrant on-time reporting, Jet Airways is prepared, and equipped, to do so, but would urge the Department to take into account its comments concerning the disclosure of cause-of-delay information and the fair and equitable treatment of carriers.

Re: Jackson Chamber of Commerce in Support of Great Lakes Airlines

The Jackson Area Chamber of Commerce Board of Directors met on January 15, 2008, and voted unanimously to request air service to Cincinnati with Great Lakes Airlines. Our reason for this request is that the service to Cincinnati with Big Sky Airlines had much more interest and passengers than when we had service to St. Louis. Particularly in light of the large number of late and/or cancelled flights, the enthusiasm for this connection was much better than any previous air service connection we have had.

Re: Ogdensburg Bridge & Port Authority in Opposition to Pan Am Clipper

After review of the PanAM proposal, the Authority Board passed a resolution requesting that USDOT place the EAS back out to bid.

Ogdensburg passengers deserve better service under EAS than what is being proposed by PanAM. It
may mean a longer delay until air service resumes, but it will, be the right decision for the traveling public.

Re: Town of Massena in Opposition to Pan Am Clipper

The Town of Massena, New York respectfully recommends that the U.S. Department of Transportation reject the Response of Pan Am for the following reasons: 

First, Pan Am does not have a code‑share or interline airline agreement with any air carrier. The ability to easily connect to another carrier is important to the community and is of the essence of the EAS program. 

Second, the Town is aware that Pan Am has service reliability issues with EAS routes in New York State, including Elmira, N.Y. 

Third, Pan Am has an on-going fitness proceeding before the Department's Fitness Division (DOT-OST-2000-7668). The very existence of this proceeding raises an issue as to whether Pan Am will be able to obtain a code-share relationship with another carrier. 

Accordingly, the Town recommends that the U.S. DOT reject the response of Pan Am and re‑issue a new request for proposals. The Town believes that this action will give other carriers an opportunity to consider responding, and will give Pan Am an opportunity to resolve some of its issues if it wishes to submit another response.

Due to our former Commercial Air Carriers lack of due diligence and 80% cancelled or late flights into and out of Adirondack Regional Airport, the confidence of the flying public has all but been destroyed. Cape Air needs to recognize that they will have to prove themselves to the flying public, beginning with the first flight, day one. After due diligence on our part, we are extremely impressed with Cape Air's commitment to excellence, community support, customer service and 98% flight competition rate.

We welcome Cape Air with open arms and look forward to working with an airline committed to community service and encourage USDOT to immediately release the contract authorizing Cape Air to operate at Adirondack Regional Airport.

Re: Village of Saranac Lake in Support of Cape Air

The Village of Saranac Lake is pleased that Cape Air has submitted an EAS proposal to serve the Adirondack Regional Airport. Cape Air will have to work hard to gain the trust and respect of the community that was lost over the last few months due to the former commercial air carrier's poor service. However, the airline has an excellent history or reliability and a business model that should allow them to be successful in our market.

We hope that Cape Air's proposal is reviewed and approved quickly so that they can begin service as soon as possible.

Comments of Jet Airways (India)

The Department should make every effort to minimize reporting and other administrative burdens on airlines, particularly if a given reporting requirement serves no practical purpose. That is clearly the case with quarterly Form 251 reports filed by Jet Airways and other foreign airlines, and section 250.10 should be promptly amended as set forth in the NPRM.

With regard to the Department's proposal to increase the maximum amounts of mandatory denied boarding compensation to $400 for international passengers who are rerouted within four hours and to $800 for international passengers who are not rerouted within that timeframe, Jet Airways believes these are reasonable increases. Jet Airways also concurs with the Department's determination to subject subsequent increases to separate public rulemakings.

Shuttle America hereby notifies the Department that it will display the designator codes of Air Canada, All Nippon Airways, British Midland Airways Limited, Qatar Airways, Q.C.S.C., TACA International Airlines, S.A., and Lineas Aereas Costarricenses S.A. on flights operated by Shuttle America, d/b/a United Express, between and among the cities listed in Exhibit A hereto. Since these markets may be served interchangeably by United and United Express services, a similar notice is being filed on this date for United in the appropriate dockets. This notice will enable United and United Express carriers such as Shuffle America to operate code-share services interchangeably to the points listed without the need to file repetitive notices as services shift from one carrier to another. The proposed code-share services are fully consistent with the applicable bilateral air transport agreements.

Notice Extending Time to File Objection to Order 2007-12-11 | Word

On January 16, 2008, Taga Air filed a motion requesting that the Department extend the due date for objections to Order 2007-12-11, to February 15, 2008. In support of its request, Taga Air states that the additional time requested would allow the company additional time to submit to the Department detailed and thorough responses describing its full compliance with the variety of issues regarding its citizenship raised in that order. Taga Air stated that it has initiated several steps to address the Department’s concerns and plans to provide the Department with updated fitness information no later than February 15, 2008.

Under these circumstances, we have determined it appropriate to grant Taga Air the extension it requested and extend the date for interested parties to file answers to the company’s objection. Therefore, we are extending the objection period to Order 2007-12-11 to February 15, 2008, and the period for the filing of answers to objections to February 26, 2008.

Thai respectfully requests that the Department renew its exemption from 49 U.S.C. § 41301 authorizing Thai to conduct (i) scheduled foreign air transportation of persons, property and mail from points behind Thailand, via Thailand and intermediate points, to a point or points in the United States, and beyond; (ii) scheduled all-cargo service between a point or points in the United States and any point or points in a third country or countries; and (iii) charter foreign air transportation of persons, property and mail between any point or points in Thailand and any point or points in the United States, and between any point or points in the United States and any point or points in third countries, for a minimum period of at least two years, and grant such other and further relief as the Department deems appropriate.

(August 7, 1998, Undocketed), Asiana Airlines (December 19, 2002, Docket OST-2002-13320), Austrian Airlines, Osteneichische Luftverkehrs AG (March 13, 2000, Docket OST-2000-6803), British Midland Airways Limited (December 3, 2003, Docket OST-2003-15758), Deutsche Lufthansa AG (April 9, 1998, Undocketed), Qatar Airways, Q.C.S.C. (July 19, 2007, Docket OST-2007-28628), Scandinavian Airlines System (May 24, 1999, Docket OST-1999-5251), TACA International Airlines, S.A., and Lineas Aereas Costarricenses S.A. (May 18, 2006, Docket OST-2006-24078), United hereby notifies the Department that United will display the designator codes of these foreign carrier partners on United's flights between and among the cities listed in Exhibit A hereto.

United and its foreign code‑share partners have previously filed most of the cities referenced in Exhibit A with the Department in the above‑referenced proceedings. Since the purpose of this notice is to update the list previously provided to the Department, the entire list is being refilled for ease of reference. To the extent that any of the cities included in this notice have not been previously noticed to the Department, code‑share service to those cities will not be implemented for a period of 30 days following the filing date of this notice.
