Just six months later, AccessAir is back seeking slot exemptions once again. AccessAir has dropped its request for slots to serve Moline/Quad Cities, and instead is seeking four slots to provide service to Peoria, Illinois, with connecting service to Des Moines. AccessAir makes this application even though it still has not received its final certification by the FAA, and even though AccessAir has submitted no evidence that the proposed traffic will be larger that the projected levels that were found inadequate six months ago. Accordingly, USDOT should, once again, reject AccessAir's application.

As it should, the Department traditionally has granted foreign air carriers slot applications in an expeditious manner. Such service is among the highest and best uses of O'Hare's available capacity, and brings in significant jobs, trade, and tourism. In 1998 alone, the Department has granted similar exemption requests to Lufthansa and Iberia for the summer 1998 season, and to SAS and Iberia for the winter 1998/99 season. In so doing, the Department recognizes its bilateral obligations, and demonstrates the tangible benefits of its liberalization and open skies efforts.

The testimony of Mr. McArtor confirms, in detail, the extensive behind-the-scenes contacts which Mr. McArtor and other representatives of Legend have had for many months with DOT decision makers. These contacts addressed the merits of the very issues the Department is considering in this proceeding. We found that grant of this authority is consistent with the public interest. The Memorandum of Understanding, initialed December 23, 1995, between the United States and the People's Republic of China provides that designated Chinese airlines may code share between named gateway points and a total of ten additional points in the United States to be selected by the Government of China, as well as between named gateway points. It also provides that the People's Republic of China may name additional gateway points. On August 4, 1998, we were notified of the Chinese Government's selection of code-share only points as well as three additional U. S. gateway cities for Chinese carrier services. All of the points requested by the Northwest/Air China application are encompassed by either the code-share only points selected or gateway points specified under the aviation agreement. In light of the Chinese Government's selections, we found no basis to withhold approval of the Northwest/Air China application as proposed by Delta. At the same time, in taking our action we were cognizant that the points selected by the Chinese Government were not reserved exclusively for the Northwest/Air China code share, but in fact could be used by other Chinese and U.S. code-share partners.

Queen Air was formed in order to increase the passenger travel and shipping options in the U.S.-Dominican Republic passenger and cargo market. U.S. carriers continue to dominate the U.S.-Dominican Republic scheduled operations from New York and Miami. Three (3) U.S. carriers (American Airlines, Continental and TWA) operate scheduled combination service from New York and Miami to Santo Domingo. Only two Dominican carriers, APA International and Air Atlantic, provide service to Santo Domingo. While cargo options from Miami have grown in number, American Airlines virtually monopolize the cargo service from New York. Queen Air will therefore enhance the existing scheduled passenger services by offering additional scheduled passenger flights from Miami, New York and San Juan to Santo Domingo. No Dominican carrier is directly serving San Juan. This additional service will provide passengers and shippers from both the Dominican Republic and the United States another carrier option to U.S. gateways.
